Statement of Claim
Claimant says:
"A new complaint has posted regarding my restaurant on 12/17/12 by a David P. The review is so much more damaging to my business than one will ever know. The complainaint says things like, " the cheesburger contained the kind of meat you'd find in a bodega where flies breed", is so subjective, not based on any fact nor has the complainant ever witnessed this condition to exist. This kind of statement is so misleading and devastating to a business, especially a food business. He's never been to our place of business once, and has never seen such conditions to exist. We boast our letter grade "A" from the NYC Health Department. We didn't get an "A" for nothing. By implying that the "meat comes from a place where flies breed", he's in fact insinuating that we have such conditions existing in our place of business.

This is so contrary to the fact and it is wrong to present it like it is a fact. He should be held legally liable for making such detrimental accusations.

I've had some of my regular customers write reviews on yelp about a year ago and they were filtered. Of course,they were 5 star reviews. And yelp filtered it out. I think you should do the same with this review. It's making claims and accusations that are not based on any facts or truth."

  • Unfortunately, there are quite a few complaints about Yelp on this site, as well as several others. In doing some research for your claim as well as others, Yelp itself is not responsible for reviews posted on its website. However, if a third party has posted a review that is defamatory in nature for your business, that third party can be liable for what they posted. A legal consultation with an attorney may be helpful to you in regards to the review itself. In the meantime, posting some form of polite rebuttal to the review may be helpful, as it will show anyone who is checking the website that you as a business care about what reviewers are saying and that you are taking steps to address them (in this case, indicate your excellent health score and why you disagree with the review).
