Statement of Claim
Claimant says:
"My father and I have worked with Mr. Mickley for a few months in order to get a reverse mortgage loan approved.. He states he worked with my father before I stepped in to approve another loan with a different company and was not able to get it done. While working with us (my father and I) some of the things he did I felt was not appropriate but I just figured that is how he worked. I have filed complaints against Mr. Mickley and Bay Equity Home Loans because of the work and the way Mr. Mickley handle my father file. He was giving us misleading information regarding the file, he kept important information from us that would have changed the outcome of the position he put us in. He is insulting, rude, careless and his work ethics are reckless.
He worked to get my father loan approved. We (Mr. Mickley and I) communicated back and forth for 4 months trying to get this loan approved. I sent him every document he needed, answered every question made sure he had all he needed to get this done. Months and months went by while he was stalling to let a appraisal time out he finally contacts us with what we thought was good news. He contacts February 5, 2016 telling us he got the "Thumbs Up" on my father file. Naturally, I responded to him with excitement and was thanking him for the work he did. I asked what was the next move and we were ready to move on. He did not correct me while I was thanking him and congratulating he let us go on thinking that his file was approved. So, when I filed the complaint against now he's saying when he says "Thumbs Up" he was" REFERRING" to submitting the to the underwriter.. When you look up the phase or term "Thumbs Up" it does not mean reference or referring too. It doesn't state this in any definition that I have looked up. It says "AN INDICATION OF SATISFACTION OR APPROVAL or A GESTURE OR APPROVAL OR ENCOURAGEMENT" To tell us he got the "Thumbs Up" then say NO.. That's not what I meant is a SLAP IN THE FACE. Mr. MIckley is a professional. This is what he does everyday. He is dealing with people lives and their money. So, when he says something is should be what he means. Not just telling people what they want to hear. Giving information that has no truth.
My next major issue is I paid out $9,200 to take care of a debt that we did not have to rush to take care of. Mr. Mickley contacted us February 24, 2016 and informed us what we needed to do to get the file approved. My father credit card debts were a issue and I understood this. So, when he bought this to my attention I didn't question it. He mentioned a few times to me that if my father credit cards debt didn't exist then he would qualify. So, If I'm able to help my father I am.. I paid the credit cards off, then contacted him to let him know. This is when he made a statement about the file being denied. I asked him a few times when was the file denied. I received no answer until lately when he answered my complaint. He states the file was denied February 18, 2016. He states he communicated this to me, which he did not do.. He DID NOT tell me he did not get the file approved. What he did tell us was to pay this money, get a new appraisal (which we did not need) and send more papers then this could go through.. I feel Mr. Mickley felt we could not pay this off, that's why he did not tell us the other options we had. If we would have told him we could not pay the debt at the time, he wouldn't have told us the file was denied. He advised us that we can try again in July, just come back to him. So, he had me empty my savings when I didn't have too. WE could have taken our time and taking care of this. He knew the file was denied and failed to tell us. And, all he says is "Sorry, We'll try again" it was flat out rude.
Mr. MIckley was only thinking about his self. He failed twice and instead of apologizing and letting us move on. He lead us in the wrong direction and has cost us nothing but pain, emptiness and a empty bank account.. I am out $9,200. That I am fighting to get half or all back. I am grateful for that the company reached out to me and offered some relief. But, I'm sorry that is not enough. I am not going to stop. I am going to search, research and file every piece of paper I can and show that Mr. William Mickley is not a man to work with."
