As a result of my legal work, we reached a settlement to dismiss the Todd County District Court case against your business, NO additional, district court judgment was entered against Hwy 27 Auto Salvage LLC by the Minnesota Pollution Control Agency (MPCA) and potentially large MPCA costs and attorney fees from 2013 through July 2017 were waived! Also I completed your new permit and stormwater applications to continue your business, which were approved on 7/17/2017! The Minnesota Dept of Revenue and MPCA would not reduce or satisfy your PRE-EXISTING, CIVIL penalties for pollution violations and unpaid sales tax, which they can collect without further court judgment. Your first violation notification was in October 2013. I was retained in March 2017, seven days before the first court hearing and continued working in this matter through the end of July 2017. You have paid me only $3000. The judgment balance due from you for the remaining, unpaid legal fees is $3,111.12 plus judgment interest and collection costs. I will agreed to satisfy this judgment if you pay to me $2900 before 3/31/2017.
I see an online record of an MPCA penalty of $9,326 for "hazardous waste violations." It appears that the claimant received notice of violations beginning in 2013 (?) and perhaps ignored them until everything had escalated - possibly because he didn't know how to handle it.
I see that the MPCA also notes that its goal is compliance with environmental standards, as well as enforcing monetary penalties. Did the claimant discuss the situation with the MPCA and how to mitigate it in October 2013 or at any other time before securing representation, or did he just ignore it and hope it would go away?
"Imposing monetary penalties is only part of the MPCA’s enforcement process. Agency staff continue to provide assistance, support, and information on the steps and tools necessary to achieve compliance for any company, individual, or local government that requests it."
If the claimant continued to pollute for four years without attempting to address the problem, I would think that the MPCA would be less inclined to negotiate anything. I have a lot of sympathy for people who don't know the law and panic, but unfortunately it doesn't resolve the problem.
The claimant needs to attach records of attempts to resolve the problem with the MPCA and contract with the attorney. If the attorney PROMISED that he could negotiate the past fines as well as preventing any future problems, the claimant may have a case.
