Claimant says:
"If the company will reimburse us for the damages we are willing not to file a claim in the City of Richmond Small Claims Court. The certified check must be be received no later than March 30, 2011"

The claimant's settlement terms were rejected with the following explanation:

    "Mr. Braunstheyn signed an invoice acknowledging his agreement with terms of cleaning and repairs. It was explained to him at the time of dropoff by two customer service representatives of our cleaning and repair policy. All cleaning is done before repairs are made due to health and safety concerns. His signature on the repair invoice and cleaning invoice gave us permission to move forward. The fact that he left the rug in our care meant he understood the terms. An estimate was given for repairs and a minimal repair charge was levied. Mr. Braunstheyn never complained about the repair when I met with him and spoke to him over the phone. He focus on the cleaning aspect of the rug which he charges damage done to an old worn oriental that came in with traffic dirt, spots and stains, stains on the back and a torn fringe. We address those issues during cleaning and with the repair. The issue with the rug is what is known in the industry as carpet shading. This is a process of pile reversal when the carpet pile doesn't lay in one direction anymore. It occurs in all types of fibers in carpets and is seen as light on one side and dark on others when the reflection of light shines on the rug. It is difficult to explained to customers after substantial wear but it results from uneven moisture, air currents, variations in floor levelness, underfloor heating and hot water services, earth rays and distortion of pile from foot traffic. I spoke earnestly about this issue but Mr. Braunstheyn like most customers failed to comprehend this issue. Mr. Braunstheyn brought in another dirty carpet similar to the one we cleaned. My supervisor and I walked around both carpets and the carpet shading effect was evident in both rugs. Mr. Braunstheyn witness this himself but still wanted to charge us with damage. Victory Rug Cleaning recceived a sign document with disclaimers giving us permission to clean and repair his carpet and it was done as promised. Victory will not pay this unreasonable request for a rug that is not worth that amount and substained natural damage over time which is common.
