Statement of Claim
Claimant says:
"1.) Communication of inaccurate information for inspection projects and causing the projects to go into hold status or being cancelled and the Independent contractor receiving reduced project payments.

2.) Late payments for completed projects.

3.) Non full payment for projects still pending.

4.) Non payment for projects already scheduled.

5.) Unfair labor practices towards Independent contractors.

6.) Non reinstatement to Premier network and on site inspections."

  • My claim still stands. You just want to do it your way and not take any feedback on your unfair labor practices towards field agents. You should be responsible for the information you provide and not blame others. I took the projects in good faith and expected to get the payment that was agreed on when taking the project not just a few dollars later because the information given was incorrect and I only received minimum payment for the project after searching for the project on line. And in regards to your pending projects you just removed them from my account after I finished the ones I had completed for the day. How fair is that? You never asked me about the projects that I had still pending to complete. You claim you asked me about them but that is not true as you claim. Why are you making special payments for completed projects which should have already been paid to field agents when they are past due? You should be making payments for projects on time instead of issuing late payments and using delays in projects as an excuse. You have not had any other complaints because no one else will take the time and energy to stand up against your unfair practices.

The claimant's settlement terms were rejected with the following explanation:

    "This is the second claim through PeopleClaim we have received from Richard Catanzaro regarding his concerns with our Onsite Inspection business practices (let it be noted that TrendSource has never received a complaint like this from any other Independent Contractor). We accepted Richard’s original claim and coached him on how we wanted to handle issues in the future. The acceptance of his original claim was in an effort to move forward in a positive manner; in this case we do not agree to Richard’s request and refuse to pay him for a number of reasons.
    Many of Richards concerns/issues stem from him not following clearly detailed instructions and/or his misunderstanding regarding who is responsible for project information. Richard’s expectations for how a project should be managed, completed and paid do not match with our or our client’s processes; therefore, we decided to no longer work with Richard. Below I have addressed each item listed in Richard’s claim to explain why we are rejecting his claim this time around.
    1) Inaccurate inspection information originates from details provided by our clients, which can therefore only be updated/fixed by the client. Richard has been told this a number of times, but continues to put the fault on TrendSource when an inspection has an issue and goes on hold or gets cancelled.
    2) We pay all Independent Contractors for completed, reviewed and verified work on the 5th and 20th of each month. If a payment is delayed due to missing information or client hold-up, we will try to issue a special payment in-between these dates to accommodate the IC. Over the last few months we have issues weekly payments (4/2, 4/5, 4/9, 4/22, 4/24, 5/6, 5/9, 5/14, 5/20, 5/28, and 6/5) to Richard to ensure payments are made as quickly as possible.
    3) The only time non-full payment is issued, is if the client cancels an inspection prior to work being completed. In these cases, it is possible that Richard has made phone call attempts to schedule an appointment for the inspection, but he has not gone out for the inspection, nor has he submitted any data from the inspection. In these situations we issue a partial payment for time and effort for calling the contact, but do not pay the full Contractor Payment since full work was not completed.
    4) Richard was given ample warning and coaching in regards to not following proper procedures to complete inspections and was told that he would no longer be allowed to pick-up projects for our OnSite Inspection business prior to any projects being removed. We gave Richard the chance to keep pending projects assigned and confirm that he would complete them. After not hearing back from Richard for an entire business day it was decided that he would need to be removed from the pending inspections, at which time we issued a partial payment for his efforts up to that point.
    5 & 6) Richard has been coached a number of times regarding his improper use of the call log since February 2013. After repeated coaching, Richard continues to do things his way, which does not work for our procedures or for our client’s needs. We have been very accommodating to Richard in the past, but no longer wish to work with him since he is not willing to work properly with us. Our Independent Contractor Agreement clearly states that either party can terminate the agreement at any point, for any reason. We have decided to use this course of action for reasons noted.
