Statement of Claim
Claimant says:
"My original Motorola phone quit working sometime in Mid- October - I did not make a note of the date because I wasn't expecting to have this issue.
That same day was when the LG phone was purchased, activated, but the number from my previous Motorola phone was to be transferred to the new phone along with the remaining minutes.
The Samsung was purchased on either Thursday the 21st or Friday the 22nd - the purchasing slip does not include date of order but it does include shipping date which is the 22nd of October and was received on the 26th via Fed-ex"

3. Compensation: had to buy airtime for each card because tracfone did not transfer the minutes from the original phone as promised by not only the CSR but also the supervisors Nov 13, 2010 $55.00
4. Damages: punitive damages for having to waste almost 4 hours with only God knows how many different CSR's and Supervisors making Larry Fultz late to work and be put on hold a dozen times or more and being disconnected or hung up on - cannot say for sure which occurred. Nov 13, 2010 $75.00
5. they should be penalized for their VERY POOR customer service yesterday - we did everything right- they didn't have a clue about what to do and now I was also told that the Samsung phone had a defective sim card which will now take at least 1.5 - 2 wks to receive.
