Statement of Claim
Claimant says:
"On Feb. 6, 2013, my wife Carole had her normal chiropratic visit (she's very satisfied with that part of their services), inquired about a back brace. They fitted her toward the end of her visit, then she checked out paying the entire bill, NO BREAKDOWN, ITEMIZED DETAILS PROVIDED.
She hurried and signed the VISA card bill (again, no details provided) and we left. When we got home we saw that the brace cost $249.00 + tax 14.94, total $263.94. I returned the brace in less than one hour and they informed me no refunds and their policy.
1) we were not advised of the price, if so, we would not hve purchased it;
2) we were not advised of the no return policy. (They claim it is posted somewhere.)"

  • My wife, Carole, was given a receipt for the TOTAL cost of the visit, NO ITEMIZED BREAKDOWN WAS PROVIDED. As she normally does, signed the VISA charge, for over $300, again, NO DETAILS PROVIDED. When we got home she showed me the receipt, and she was surprised and had NO IDEA, the back brace cost $265. I was back at their business in less than an hour and they refused any refund and still claim what they did was correct and ethical.
    Taking advantage of an elderly person who is in lots of pain, who likes and trusts the people at this business, without a COMPLETE explanation of what she is buying, is, in my opinion, unethical and why I got upset. Their response above is both inaccurate and a cover up the facts. This reflects poor management, insensitive tretment of a loyal, long term customer, that has spent thousands of dollars at this place of business.

  • Total Health's response is a "total lie". They didn't go over their so called no return policy, I tried to reason with them to no avail, and, yes, I got upset at their "total screw you" attitude of no returns less than a hour after the purchase. This happens after we had spent thousands of dollars in treatments over 3-4 years. They are greedy, and I think somewhat shady, and have a great marketing program but little else.

  • "The purchase of this brace was made by the claimant's wife, who asked for assistance with her travels due to back pain. Upon check out it is office policy to go over pricing and return policy with items purchased. There is also a sign posted reiterating this policy. The patient agreed to these terms when purchasing the brace. When checking the patient out, she was given a receipt for entire purchase made and services, with the claimant standing right next to her. This entire matter has been handled in a very rude and disrespectful way to our office. Loud and obnoxiousness behavior in front of other patients in hopes to have the policy changed, was unappreciated and unacceptable and has resulted in no longer being welcomed into the office. This policy has been in place and utilized for the protection of our patients to ensure they are receiving the best care and unused products for their healthcare assistance. "

  • Since I was not present at the time of check out or the explanation (or lack of) for cost and services provided, have you had time to reflect on your actions and reactions? Since the only thing in a conflict situation you can change is how you react, do you feel you could have handled anything better? If so, perhaps a fresh start would be best. Think about the situation and create several scenarios of resolution that would be acceptable to you. Then request a private meeting with the office manager or chiropractor to discuss what happened.

    If you feel, after reflection, that you acted in a completely reasonable and professional manner and that nothing you said or did was out of line, my suggestion is to write a certified letter to them, outlining your chronological recollection of the facts and ask for the remedy that would make you feel whole.

    If they do have signs posted that indicate all sales are final, you may have to live with this purchase. However, aside from the money, is the brace helping your wife? If so, you need to ask yourself what is most important: Being right or the comfort of your wife.
