Additional Communication Between Claimant and Surefire Contracting Inc. (Lenexa, Ks) Hide
  • Apr 13, 2016, Surefire Contracting Inc. (Lenexa, KS) (responding party) added:
  • Answer to 1) sure-Fire hired sub contractor. Bob Homolka hired sub contractor out from under Sure-Fire to perform different scope of work and to deviate from design. Bob Homolka also hired this same sub for additional work not authorized by Sure-Fire and was worked discussed for Sure-Fire to perform.
    2) Metal screen is missing and brick is missing.
3)no dishonesty here amount agreed upon was Changed by Bob Homolka and contract reflects price change.
4)there is no amount on cell phones other than amount asking to be paid of $3600.
5)contractor was on job several times again Mr. Homolka was meddling in things he was not supposed to be as a customer. The supplies where order for sub and delivered to sub off his estimate to complete and perform. The sub did not use material or used to much or walked of with that is his issues and Sure-Fires to negotiate not BoB homolkas. Bob has no idea or would ever or should ever been negotiating making agreements purchasing material for this sub. That is Bob issues of purchasing anything and is Breach of contract. Bobs action has caused much cost and liability to Sure-Fire do to his inappactions.
At no circumstances a owner should have to be on a job to guarantee payment. I employ people to do the job and supervise those jobs. The fact Bob thinks he shouldn't pay because of the amount of time I was on the job is ludicrous.
    6) your letters have been threats and have all been given to my attorney for collection and future charges if this continues.
7)pictures of a job done incorrectly due to the customers actions just shows the mistake and issues you caused yourself by getting people drunk giving materials and money to someone you didn't hire or have a contract with. I can't control your actions or damages.
8)slander and threats will only cost you more money. It may even become criminal if you continue.

I am going to add that if this site post negative results on a report with these type of issues they will be included into the suit.

  • First off all damages must be protected at immediate notice of leakage. Mr Homolka continues to cause himself more damages and cost do to his actions. Sure-Fire again will ask for this organization to take all information into advisement before slandering this company or they to will be responsible for the slander.

  • Mr. Homolka asked for compensation from original contract as we granted. Mr. Homolka was advised that the chimney should be tore out and rebuilt he only wanted repair. Contract was signed and work began. Mr. Homolka decided to direct Sub contractor to deviate from scope of work and void contract as written. Me Homolka supplied sub with substantial amount of alcohol to sub while on a roof. This resulted in poor workmanship. Mr. Homolka directed sub under the influence to change design and scope of work written and drawn on contract. Mr. Homolka tried to sell and did take materials from jobsite. This is even stated in a letter posted at job site when we arrived to pick up returns and clean up. Sure-Fire still completed job and did clean up including the picking up of beer bottles 26 bottles and caps on and off of roof. The roof was temporarily sealed and Mr. Homolka was advised to repair immediately to avoid damage. It is unfortunate he has suffered damages due to his actions. Mr. Homolka has continued hiring sub to finish work and other work Sure-Fire was asked to perform. As to the claim of hours on the job by Sure-Fire a company has profit and overhead and doesn't have to be on job continuously if subcontractor is there. The whole purpose of this claim is Mr Homolka wanted to pay what we negotiated with our sub and not pay Sure-Fire. Sure-Fire is insured paid for materials contracted the job and put all of that out of there pocket to perform. This is why we are a business. And our sub does not have the funds or abilities to perform without are direction. As a result of you getting dub drunk and discussing terms that where not supposed to be discussed you paid sub to deviate and bad results happened.
