Statement of Claim
Claimant says:
"We had a written deal (from Frank Gray, Fleet Manager) for a car. When we went to pick up the car Frank asked for an additional $300. We renegotiated & he verbally confirmed the original deal. Then Frank left. Jason took over the deal. Jason insisted we take another test drive. We reluctantly agreed. Jason then reneged on the deal. We renegotiated again. Jason then agreed to the original deal. Then a third person reneged on the deal. When we first arrived Frank said they did not want a cashier"s check. He said they preferred cash or a personal check. While we waiting we were told that they had to run a credit report for the cashier"s check."

  • Sierra Honda has made several deals for different cars, but failed to deliver any of the cars. The cars & prices change each time. As there is no resolution in sight, we bought the car at a different deal. Yes, Mary Lopez was the buyer. I negotiated the deal. For me, it was $24,650. For her it was $24,950. California pass a law against gender pricing in 1996. They accepted the term as they know we already bought the car elsewhere. Thus, they agreed to a deal that is no longer vaid. I do want this to be publics they had every opportunity to make this deal, but waited until we went elsewhere.

  • They made this agreement with you after I told them we bought elsewhere. They agreed to a deal they no longer have to honor. They made this agreement in bad faith. February 29, 2016 is too long to wait for a car that may or may not be available. Also, last time they had the car they raised the price when they saw it was for a lady. That is illegal.

  • Also, they said they sold the car because we could not make a deal. We had a written deal in place. They reneged on the deal. I sent you copies of the written deal. This took place on January 16, 2016. They are asking us to wait 45 days for a car. Your deadline was February 3, 2016. There solution is 27 days later, if they follow through. They know we needed a second car as soon as possible. They are aware that we have been renting a car for nearly two weeks.

  • The terms were NOT accepted. Please noted the due date was February 3, 2016. Today is February 4, 2016 & no car has been produced.

What Claimant Wants Hide
Message from Sierra Honda: The vehicle we had for Mr. Eskue was sold to someone else after we failed to sell it to him as described in his complaint. We were unable to locate another vehicle like it for several days. The first vehicle we were able to find is inbound to another dealer and will arrive next month. The other dealer agreed to sell it to us when it comes in and we offered that vehicle to Mr. Eskue for $24,650 out the door. It is our understanding that he has refused this offer. It is also our understanding that Mr. Eskue is not the actual buyer, but he is our sole point of contact on this transaction. In that we would have to acquire this vehicle from another dealer, our offer as to the vehicle and the price expires at the earlier to occur of the arrival of the vehicle at the other dealer (we won't trade for it if Mr. Eskue is no longer interested in it) or February 29, 2016.
