Statement of Claim
Claimant says:
"Purchased $499.00 Sewing machine for a neighbor, paid in full via credit card.
received machine 05/20/14 or about. several weeks later received letter(inclosed) from a Lauren Helbert stating she sent me several e-mail labels to send back a second sewing machine I supposedly received from them vie there error.
The time it was supposedly sent the receiving address was vacant, I was in NY for several months.

July 30th or about I received a threat from Ms. Lauren Helbert via US MAIL stating I will be held responsible for the machine they sent which I did not order nor receive or want I must pay her $499.00. In fear of affecting my credit by this false accusation I request to notify several agency' to protect my reputation and mainly my credit.

Will appreciate any assistance in this matter to have Ms. Lauren Helbedrt cease any other communications to me.

    Per your insistence at the time of our previous conversations that you had not received the additional machine, we considered this matter closed. We have not filed anything with any agency. We do apologize for any inconvenience, as we thought this had been communicated to you.

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "This customer was sent 2 machines in error. We contacted him and sent him a UPS shipping label to return the 2nd machine to us on June 11. He did not return the machine. On July 16th, we sent him an email because there was no movement on the label. This is what we emailed him: I am inquiring if you are sending back the duplicate “Consew CP206R Portable Walking Foot Machine”? I do not see any movement. After checking again on July 28th and still no movement on the tracking, we sent Mr Butler a letter, demanding he either return the 2nd machine or make arrangements to pay for it. The customer received a duplicate order from us and we asked him to return it and he refused to. We ended up having to write off the order, since he would not pay for it and would not return it.
    This is the proof of delivery on the 2nd machine that he received from us:

    and here is the tracking info on the first machine that he received from us.

    The customer received two machines in error and will not return the 2nd one to us. "
