Claimant says:
"I rented unit 27-C for my daughter over the Summer. She had to leave the apartment September 15th. Upon giving her notice over 30 days prior, she was told she had to find a new tenant to take over her lease, which she did.

I sent a check for $550, which was September's rent. We were told we would get half of that back since she left the apartment on the 15th. During the walkthrough my daughter was told we would get the $400 deposit back minus $150 for the Lease Transfer, $100 for carpet cleaning, $25 for the walkthrough (ridiculous!!) So that plus the refund for September’s rent totals $400 we should have gotten back last month. The woman in charge (Tracey) said she had a month to process the refund… it’s been almost 2 months - still no refund OR returned calls/ texts."

  • I understand my rights under the law which will follow below, and I hereby want to exercise them.

    I'm not sure why RVA Property Management thinks they can blow me off. They can't. There are laws about security deposits. Even ignoring the ludicrous fee for a walk through - which is a normal part of the job for a property manager - and the carpet cleaning, which should be unnecessary since my daughter only occupied the 1BR apartment for 4 months - they hAD 30 days to return my deposit, as they themselves admitted to me.

    "No later than 30 days after the day the tenant vacates and returns possession of the rental property to the landlord, the landlord must deliver to the tenant at the tenant's last known address the balance of any deposit, the balance of any prepaid rent, and a written notice itemizing and explaining any reason for any deduction the landlord made from the deposit or prepaid rent. Utah Code Section 57-17-3(2).

    If the landlord fails to follow the requirements of Utah Code Section 57-17-3(2), the tenant may serve the landlord or the landlord's agent a notice that states the names of the parties to the rental agreement, the day the tenant vacated the rental property, that the landlord failed to comply with Utah Code Section 57-17-3(2), and the address where the landlord may send the deposit or remaining deposit funds.

    The tenant may recover from the landlord, if the tenant has served the required notice:
    The full deposit if the landlord fails to timely return the balance of the tenant's deposit;
    The full amount of prepaid rent if the landlord fails to timely return the balance of the tenant's prepaid rent; and
    A civil penalty of $100.

    The tenant may file an action in district court to make the landlord comply with the requirements of Utah Code Sections 57-17-1 through 5"
    If I don't get a response in the next seven days, I will pursue resolution of this issue in court.
