Statement of Claim
Claimant says:
"Miss Wells, a representative for Princeton Properties LL C located at 6370 E McDowell Rd, Ste 136, Scottsdale, AZ 85257 contacted me through a posting on Craigslist about painting a condo.
Through emails we agreed that her pricing was reasonable at 325.00. When I saw the condo to be painted I realized she was way off on her estimate.
I painted a 2 bedroom 2 bath condo for Miss Wells. Standard for the price quoted is 1 coat 1 color all walls and trim. Upon talking to Wells she stated she wanted 3 rooms primed including ceilings, 3 wall colors, 2 coats of paint, closets 2 colors, white trim throughout and ceilings white after primer. Since this was well over and above the advertised paint job she listed I expected to be paid a fair and reasonable wage for the extra work done.
Since I contacted her on number of occasions, including letting her know that the price was going to be higher (left on her voice mail and emailed), and she refused to respond or acknowledge that I said any such thing, I took the keys to the condo with me when I left. This was on Saturday December 3, 2011 and only after meeting with her on December the 2nd when she refused to pay me since there was touch-up she wanted done and she did not trust me to complete, which I did on Friday and Saturday.
She offered to meet me and give payment, her suggestion not mine, when the work was completed since she did not trust me to complete it. I called her twice on Saturday trying to get her to meet me at the condo and she did not respond. I also made her aware that the paint she expected to be used was gone and I could not get more since all she supplied was oops paint purchased at a discount rate from Home Depot making most touch ups impossible. I also find it hard to believe she blames me for poor coverage when she bought and supplied below standard quality paint to do the job required. She wanted satin placed on trim? Industry standard is gloss finish for all trim.
I sent an email specifically to arrange this meeting and return the keys when I was paid.
She never acknowledge my email and changed the locks on the condo and now not only refuses to pay for all the work completed but sent a check with the locks included and deductions from the amount she claims she owes after her expenses. So instead of the even sending the 325.00 she sent a check for 207.00.
The total cost of a project of this scope would have been between 1000-1250 dollars for completion. I offered to accept a payment of between 12 and 15 dollars an hour which was her posted price for work completed. She refused to pay even that amount. She also claims a fee of 25 dollars for touch-up? I offered to do what ever it took to make her happy and went over the entire project before leaving. At most there was a few minutes work to touch up and she claims 25 dollars for this work? Seems she values her time much more highly then the skilled labor she hires.
Since she refuses to be reasonable about this matter I am no longer willing to accept less than the amount listed as fair and reasonable above. Or the amount of 1000 to 1250 dollars for time wasted and spent trying to resolve this matter.
If this matter is not resolved to my satisfaction within a two week period beginning today Tuesday December13, 2011 I will take this matter to court and will sue for my time and filing fees over and above the amount a fore mentioned."
