Statement of Claim
Claimant says:
"I took my refrigerated truck to quality reefer service to be repaired .I talked to Kevin and told him the truck was not cooling he said ok no problem. The date of the repair was 9-15. He called me and said the bill was $1,456, I said ok and went to pick the truck up. When my co-worker and I got there he said there was a leak in the system it’s not cooling he showed my co-worker the part that needed to be fixed on the truck and said it would be another 400 dollars, I said ok; another week later he called and said the truck was ready and that he had it down to 40 degrees; I said ok I will be there to pick it up. I paid the bill $1847 and drove the truck home with the reefer unit on but it didn’t get down to 40 degrees. I again called kelvin back and he said bring the truck back in. So I turned right back around and took the truck back, he said give him another week, I said ok. After a week I called and Kevin said the truck is ready so I went back and picked up the truck that he said was working. I drove the truck home but it still wasn’t working. I called and said this is the third time you’ve said the truck was fixed; I have paid you, why isn’t my truck cooling like you stated? Twice you told me you had it down to 40 degrees; “why can’t I get it down to 40 degrees like you said?” I feel strongly that he took advantage of me. So I tried to put a stop payment on the check, my bank said that they would investigate the issue and try to refund me my money. But sadly they were unable to get my money back. This is not right by any means the way I was treated. Now he won’t talk to me, because he said I shouldn’t have tried to stop payment on the check I wrote him for repairs. He is not out any money he still has the money for all the repairs he didn’t do. I didn’t know any other way to handle the situation. I feel completely taken advantage of. I had to send my truck to another reefer repair shop for repairs. I was told the unit could not be repaired and needed to be replaced. They showed me how the unit was wired wrong, had no freon and needed a second compressor. I was told this unit Zanotti is no longer in business and the parts are impossible to get. I now have to put out $5000 dollars to get my truck running. My business is suffering because of this. I only had so much startup capital. I feel completely taken advantage of, it’s really hard being a female business owner."

  • Thank you for responding to me. Kevin when I brought the truck to you I told you the outside unit was not working and asked you to look at the unit and see if it could be repaired or needed to be replaced. You told me you could repair it. I know the unit had rust that's why I brought it to you to get your professional opinion. You stated you could fix it. So I agreed to have you fix it. But if the unit was so rusty why would you piece it together instead of replacing it, this makes no sense to me. Three times the truck was taken to you all three times you said that you had fixed it and all test runs you were able to get the truck down to 40 degrees. Not once has the truck been down to 40 degrees, the lowest the truck went down to was 75. After taking the truck to you three times I was fed up with your lies. The truck I brought you came from Illinois the doors and the inside bed where in great shape nothing is falling off or breaking through the floor. But you know this, why you continue to lie is beyond me. Not one time did you discuss warranty, but you have made two different quotes about the warranty no warrant to maybe covered in the warranty. I was always told when a professional does a repair and refuses to give you a warranty then he is an dishonest business man and fraud. I used you as my mechanic because you are an expert in reefer repair. But thats was what you said to me. Instead I get nothing but excuses of why the unit won't work. I noticed you didn't mention the need for a second compressor to run the reefer unit. This lets me know you planned on using my lack of knowledge for your own personal gain. Since having the truck to your shop three times the truck has been inspected by two different reefer repair shops. I was told to stop taking it to you because you were taking advantage of me. The unit you pieced together is not worth repairing and needed to be replaced, but you knew that too. The truck will be ready this week and I will take pictures of the rusty unit that you pieced together for $1847 dollars. By no means am I satisfied with your explanation. My business has suffered greatly because of this circus with you.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Customer has old rusty unit & ask us to get it going on 09/15/2015. We found unit has lot of problems and advised customer the issues (Repair as much as we can, no warranty). As customer choice & agreed, we performed the repairs as stated. Eventually, the unit is rusty we'd to repaired all what we can see or found. We did run test before released unit to customer (with 9 degree cross air difference), customer also have the problem with the refrigerated body insulation thin & bad, door seal are bad, floor insulation fall apart & we did ask customer to have those repair as well. About a week later, customer call and said it's not cooling so we ask them to bring back for inspection & it may fall under warranty that what we've done to the unit but they never show up since then. On top of that, customer filed charge back on us. Yes, he did call to to dispute & ask for credit to their account and we'd denied. Just remember, customer has rusty unit & may easy to cause leak any where when driving down the road. Since the all problems occurs, cheating in payment agreement, unpleasant communication & cursing by customer, we've told the customer that we're not accepting any kind of work from them & that's our rights. Another thing, Zanotti network is still exist & getting stronger in USA & our network are expanding statewide. "

  • Questions to Quality Reefer: Did the customer explain her need to have the refrigeration capable of at least 40 degrees when she brought you her truck? If so, did you say, "OK no problem," as she reports? You respond here that "Customer has old rusty unit." In looking the truck over before accepting the job did its condition bring up doubts whether your repair could make it meet the 40-degree requirement? If so, did you tell her clearly that it might not be repairable to that refrigeration level? What is the "9 degrees cross air difference"?
