Statement of Claim
Claimant says:
"bought carpeting for the whole house.pro floor called an installer who does work for them, who contacted me on putting in the carpet.carpet was installed.carpet got ripples in it. pro floor had a man com out & stretch carpet, carpet is seperating from backing,so i called pro floor about this.they had one of their men come out & look at the carpet, and told my husband and I the carpet is defective.i contacted the BBB on this, and they are making excuses that its the installers fault. i contacted the installer, and he said the carpet is defective, and old carpet.i found a piece of the carpet with a date of 2006 on it, and looks like water damage on the back of carpet from sitting in a leaky warehouse.carpet is seperating from weaving.i am getting no satisfaction from pro floor or the installer on this. i would like a answer on this in one week from 02-20-2014,for i have been going round and around with this company for a month now.i have phone and e-mail documentation on these things to use if necessary."

  • We have spoke to Mrs.Samp about her carpet problem several times. We have also sent out an installer at our expense to re strech the carpet for her. She is still not happy. If the carpet was defective the carpet company would replace it for her,but the carpet is not defective. So at this time we will give her the money back she spent for the living room carpet and pad.

  • Mar 12, 2014, Pro Floor Carpeting (responding party) added:
  • Mrs Samp first the problem was only the living room carpet , now you claiming it is all the carpet. This should prove to everyone it is you that's being unreasonable. We have tried to rectify the problem but the problem keeps changing. Our last and final offer was to give you all the money back that you paid for the living room carpet and pad and to move all the furniture for you. Keeping in mind you have used this carpet for over 18 months. Now you have changed the problem and we feel there is nothing more we can do for you.

  • Mar 12, 2014, Claiming party added:
  • read my responses from the last two times.i am not being unreasonable.the [roc] came out to my house & told me ALL the carpet is defected.if you would have been professional the first time and took care of the livingroom carpet, I wouldn't have contacted the ROC and found out you are selling sub-standard carpeting, that is your fault.like I told you before,we can let the [roc] take care of this[which is filed with them],or I also could take you to small claims court[with the[roc] as a witness],and go for the maximum $5,000.00,the choice is yours.i am not dropping this case, you are taking advantage of the elderly.i don't care if the carpet is 18 months old. it should last longer than that.if you say its a manufacturer defect, call up the company and you get your money back.tony Sylvester told me you buy your carpet in las vegas for $25.00 a roll, prove him wrong.it seems like you cant get a warranty on sub-standard resale carpeting.this will be MY last offer to you.&2500.00 for all my time & trouble.the longer you take, the more im going to ask.

  • Apr 30, 2014, Claiming party added:
  • I am wondering if you are going to take care of this carpet problem?if we cannot come to an understanding soon, I will be forced to take this to the district attorney, and then to a lawyer for small claims court. I received a letter from the district attorneys office that the register of contractors filed, and not heard of a response from you yet.if I do not hear by 05-05-2014.i will be once again filing against you to resolve this on going problem.PS.{ by the way, you say its an unstall problem, and the last one to touch the carpet is responsible, your man Dave, was the last one to touch the carpet.and PLEASE don't say he doesn't work for you .I have a card with his name, and your business logo on it

What Claimant Wants Hide
Message from Claimant: as I explained before, the ROC came over to my house and said ALL the carpet is defective.you can take it all out and I will get it from another company.pro floor has caused me grief with this carpet, and did not act professional about this situation.I will still have to pay someone to move my furniture out of the house to have new carpet put in, and have someone bring the furniture back in the house.I did this once, and don't feel I should have to keep doing this.if you do not want to settle with the $2000.00,we can let the ROC decide.you can call them to find out if you don't believe I filed a claim.I filed on 02-18-2014.
1. take out all the carpet Mar 25, 2014 $2,000.00

Mrs. Samp's total bill at Pro- Flor was only $1271.59 that includes 3 more rooms of carpet she is appearantly happy with. This is the best we can do to resolve the problem.
