Statement of Claim
Claimant says:
"My mom and I have been waiting for almost 2 years to have our foundation fixed. Contract was signed by my father who since then had passed away . It was signed in December of 2012 along with over $ 5,000.00 deposit. Foundation is getting worse and worse with many cracks inside the building all the way to the 2nd floor(it's a 2 flat brick building)Windows have a gap in them and the cold is going out the windows for the second winter in row.Heat $$$$ are going out the window too.My senior mom and I would like to sell the house and down size, but we can because we are at the mercy of these hypokritical people and company. They gave me few dates when it was supposed to be done but it never happened, instead they demanded plat of survey, topography and 2 sample drillings at my cost( first time they did not go deep enough).I been in contact with them this whole time and they keep telling me that they are having problems with city and engineers. Something is very fishy here. Now they don't even respond to my emails or my phone calls. People I was in contact with are : Michael McEvilly,Lorna Watson, Robert Barscewski and Dan Schoendorff. My mom is old and has health issues and is constantly asking me what is going on and is mentaly affecting her.I am so frustraded and fed up. Can you please help me.We need the work done...there is still time before it gets real cold and or money back. Please, please help.Thank you so much and hope to hear from you soon."

  • We wanted to apologize for all the frustrations and inconveniences Mrs. Erzic has had to endure. Unfortunately we had issues with permitting for this job. We have now procured the permits from the city of Chicago and we are set to install in February.

  • Jul 28, 2015, Perma-Seal (responding party) added:
  • We want to first apologize to the Erzic family for all the frustrations and stress that this may have caused the family. When this job was sold, we had not acquired a permit in the City of Chicago to perform structural work, this is the normal course of action for us. We had assumed that obtaining this permit would not be as big a problem as it turned out to be. After two years of back and forth with the City of Chicago, they finally approved a permit to perform structural work within the city limits. We went ahead and informed our client of this and we set a date to perform this work. Unfortunately, the City of Chicago stopped our progress and would not approve the material that we use for structural work. When we informed our client of this, we came to an agreement that we would refund their deposit plus any expenses they incurred along with interest on the deposit we had received from them. We received invoices from the client for the expenses via email and moved forward with processing the refund to them because we would be unable to do the work based on the City of Chicago’s requirements. A check was mailed to our client on March 31, 2015. On April 14, 2015 we received the check we sent for the refund. So, while we in good faith tried to resolve this issue and we had an agreement with our client via email, our changed her mind. Unfortunately, it does not change the fact that the City of Chicago will not let us complete this job with the materials that we use. Write your message here
