Statement of Claim
Claimant says:
"I went to Pepboys to have an oil & brake change. The service manager informed me that when they do a brake change they have to do inspection first and then asked me if I understand that as though I was speaking another language and didn't comprehend to what he was talking about. I told him that that was fine to the inspection. I left my Honda Element there and was told he would call to update me with anything they find or when finished with my car. I recieved a call later and was told that My brake hose were contaminated so I would need to repair done to my master cylinder, all caIipers, all brakes hoses, new brakes and rotors. I asked how much was it going to cost me, they quoted Two-Thousand and some change. I was mad and said I am going to pick up my car. On my way to Pepboys, I called and Brian answered the phone. I asked for the status of my Honda Element and he said they ordered a cap for the master cylinder and advised me to not pick up the car until it arrived the next day. So I took his word for it and left it there for the next day. The next day arrived and I called Pepboys, the service manager got on the phone and explained to me that my car is not drivable. He said that when they did a brake inspection-the line that they forced into my brake hose-broke. I was mad and told them that I am coming to pick up my car and to have ALL my parts in m car if it isn't still on my car. I called a tow company that is with my car insurance and they towed my car back home. My car was drivable when I arrived there and left with my Honda Element on a tow-truck. TERRIBLE Business!"

  • Terrible business indeed..well, couple of things contributed in this business which resulted into this terrible business. The claimants inability to understand the language in which the service manager was talking with him but still showing acceptance, In this case there was acceptance. When the claimant was informed about the repair works that need to be done and its expected cost , it was his duty to explicitly say "No" to this repair work. The main issue which created trouble starts when the claimant after getting notice that the company has ordered a cap for the master cylinder waited a day. Was that shows acceptance of Offer? To clarify this stance we need more information about the discussion between the claimant and the respondent on that very day. Was the claimant show acceptance for a cap for the master cylinder or was that an implied acceptance?
