Statement of Claim
"I'm very upset with Patio Enclosures Inc. In October 12, 2012 I signed a contract with
Ted Naydan to construct a room in my apartment at 2901 Boston St. Apt. 310, Baltimore MD. The agreement in the contract is that the room would be completed before Thanksgiving. Time went on, no one contacted me, and getting very close to Thanksgiving. I was nice enough to say to Mr. Naydan..."please finish before Xmas". Once again time went on and they never did anything to build this room for me. I sent an E-mail to Ted Nadan and Mgr. Jeff Tice on 11/25/2012 and asked them to return my down-
payment of $4,800.00 since I no longer have any confidence in this company. They claimed after I sent this last e-mail of 11/25 that they were busy cutting trees and cutting
power lines. They never contacted me with their problem until I sent the final e-mail.
I want this company to return my $4,800.00 since I have no confindence in them to ever
complete this job. Please put to the attention of Kenneth S. Sekley of Patio Enclosures."

  • PATIO ENCLOSURES & MGR. JEFF TICE HAS CONTACTED ME AND HE KNOWS I PUT THIS OUT ON THE INTERNET. HOWEVER, I DON'T KNOW IF HE READ ANY OF MY PREVIOUS STATEMENTS.

    EMAILED ME TO LET ME KNOW THEY WOULD BE UNABLE TO COMPLETE THE
    PROJECT BEFORE THANKSGIVING...I REALIZED NOTHING WAS GETTING DONE
    OR EVEN STARTED SO I TOLD THEM THEY MAY COMPLETE THE JOB AFTER
    THANKSGIVING. THEN IT WAS AGREED THEY WOULD FINISH IT BY THE END
    OF NOVEMBER OF WHICH I HAVE AN E-MAIL FROM TED NAYDAN WHERE HE
    STATES THE PROJECT WOULD BE COMPLETED BY THE END OF NOVEMBER. ONCE AGAIN NOTHING WAS EVER STARTED. I SENT A LETTER TO THEM ON
    NOV 25, THEY DID NOT START ANYTHING, NO DRAWINGS, NO PERMITS, WERE
    GIVEN TO ME. HOW COULD I POSSIBLY LET THEM DO ANYTHING IN MY APARTMENT IF I DIDN'T KNOW WHAT THEY WERE GOING TO DO. IN THIS
    LETTER OF NOV 25 AND MY LAST CONTACT WITH THEM BEING NOV 16, I COULD ONLY ASSUME THEY DID NOT WANT TO DO THIS JOB FOR ME. I BELIEVE THIS JOB WAS ABOVE THEIR SCOPE OR THEY WERE BEING TOTALLY NEGLIGENT TOWARDS ME.

The claimant's settlement terms were rejected with the following explanation:

    "Ted Naydan, the salesman, originally saw Mrs. Culfogienis on June 15, 2012 to talk about modifications to her condo’s family room and building a loft. Over the next few months they discussed the project back and forth.
    Mrs. Culfogienis called the call center and Tara set an appointment on 10-10-12 to go ahead with the project. We signed a contract with her on 10-12-12 for $10,752 to build the loft. The original contract was to be completed by Thanksgiving 2012. Mrs. Culfogienis canceled the contract during the three day recession period. She then reinstated the contract on 10-16-12, and wanted to add to the scope of the original project, increasing the contract to $14,502.
    On 10-28-12 Mrs. Culfogienis sent us an email saying it has been 12 days and she has not heard from us. We emailed back on 10-29-12 informing her that our measure man would be out the next week and Ted Naydan would also be out to add the design changes she wanted.
    On 11-6-2012 Mrs. Culfogienis changed the scope of the contract with another addition increasing the contract price to $14,932. The Thanksgiving completion date was removed from the contract with this change order as the customer was told it could not be completed by that date. We continued working on the project and had it scheduled to commence in early December.
    On 11-25-12 we received a letter from Mrs. Culfogienis stating she wanted her deposit returned or she would report us to the proper authorities. I called Mrs. Culfogienis and offered to come out and start work the following day. She refused and said we were not allowed on her property and hung up on me.
    During the next 2 weeks we called and email Mrs. Culfogienis several times to see if we could come out and start the project for her with no response.
    On 1-4-13 we received a letter from Attorney Amanda Zorn, Mrs. Culfogienis attorney, requesting her deposit be returned. I called and spoke to the attorney and showed her where in the contract it says that if a customer cancels the contract they forfeit their deposit. She agreed that we were within our rights and acknowledged that we would still be happy to do the project for Mrs. Culfogienis, that we could start tomorrow and be completed within 2 weeks. She said, “Let me call my client.” Attorney Zorn informed us that Mrs. Culfogienis refused and she personally said she was dropping the case. We closed the file as inactive.
    On 3-28-13 Attorney Zorn called me and asked if we would still be willing to do the project as Mrs. Culfogienis called her and asked to reinstate it. I said, “Yes, we would be happy to” and I would call her next week to set up a start date. We believed we were proceeding with the project and put her back on the schedule.
    On Saturday 3-30-13 Mrs. Culfogienis filled out her complaint via the PeopleClaim.com. On 4-1-13 I place a call to Attorney Zorn to find out what was happening. She said she had no idea as she thought we were proceeding with the project. Attorney Zorn called me later that day to inform me that she no longer represented Mrs. Culfogienis. I then called Mrs. Culfogienis to find out what was happening. She said she wanted to do the project, just not with us. I again offered to do the project and she said no.
    Patio Enclosures stands ready to build the project for Mrs. Culfogienis as per her contract.
