Statement of Claim
Claimant says:
"These people are taught shady business practices. For one thing when you're late they say that they want to help you but in all actuality they're just trying to stay one step ahead of you to get your home.We have had a lot of medical emergencies that has put a damper on our bills a bit and also we have had major car repairs of $2500.00 and more, but when we became two months late we were sending THE 1st late payment in and this has been a couple times. So in actual truth we were about 35 days late, but they sent us a preforeclosure notice for 45 days in advance and they wanted $2800.+ . They have done this twice at two different times. Also they have listed us as being late evey month since they have had the loan . We haven't been late every month, cause they hold the payments to make them all look late. Just like now, they haven't CASHED OUR CHECK YET FOR OUR NOVEMBER PAYMENT That was mailed on 12/07/2012. Also when I pay online they won't collect until 9 days or more later. THEY ARE VERY RUDE. I am handicapped with one leg and have severe nerve pain and these people would start calling me on the first day the payment WAS DUE EVERY DAY,SOMETIMES 2 AND 3 TIMES A DAY UNTIL THE PAYMENT WAS PAID. iT DIDN'T MATTER TO THEM WHEN YOU TOLD THEM YOU WERE IN A PINCH AT THE DUE DATE AND THE REASON WHY. THEY ASSUMED YOU WOULDN'T BE ABLE TO PAY AT ALL AND WANTED YOU TO REMODIFY YOUR LOAN. ALSO THEY WOULD TELL ME i SHOULD PAY MY BILLS. AT THIS POINT WE OWE FOR DECEMBER AND ON THE 16TH IS THE END OF THE GRACE PERIOD, WHICH THEY DON'T ACKNOWLEDGE AT ALL ACCORDING TO THEM THEY WANT 1800.00+ AND OUR PAYMENT IS
$925.+ AND OUR 2ND MORTGAE IS $277.54 WHICH IS ALSO DUE FOR DECEMBER. SO THEY ARE ADDING EITHER THE FIRST MORTGAGE payment for Jan.2013 or the extra money is just other charges they added on. Let's mention our escrow.Our escrow paments are $144.+ each month so that comes to about $1700.+ our taxes are now $884.+ and our insurance is about
$554.+. Now that totals about $1338.+ a year. They claim we only have $137.00 in escrow.
Somewhere about $250.00 is short changed. We didn't go with this loan company our mortgage was sold to them from HomEq, and after they took it over they said we were money behind in escrow that we had to pay to them. This company needs to be stopped..."

  • I have a couple of questions. One, have you ever requested a payment history for the term of your loan? Second, you mention the escrow shortage issue. Have you ever inquired as to whether your current, chosen insurance policy is what is in place, or have they purchased a new insurance for your policy? This has been a previous issue with this particular company (force-placed insurance when you had a current existing policy). The payment history is something that is very important in this situation, because with that, you can see if they are possibly saying you are late for a payment earlier than what you believe you are late for. You can also see where escrow payments have been made. That can help you in potentially solving your issue with this company. In the meantime, you should contact a HUD approved housing counselor. They can have more information about how to work on this particular issue that you are having.
