Statement of Claim
Claimant says:
"I put down a down payment of 2000.00 dollars for a 2006 Dodge Charger. I took it back 3 days later because the brakes were going bad, the seat belt was messed up, and the check engine light never goes off. After 3 business days the car was supposedly ready. I took it home and it went well for about a week. I was at a very busy intersection and the car completely shut off. I tried to start it and it wouldn't start. 10 minutes later it started . the next day i took my mom to work and it shut off again in the middle of the road . It didn't start for another 10 minutes. I took the car back and told the manager that I didn't want it anymore because apparently it was not ready to sell. I called the next day and spoke to a mechanic about the situation he agreed with me that that car never was to be sold."

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"Vehicle was sold to Wanda Whitehurst, on October 11,2013 I physically went over with contract with the parties involved .Yes, three days later they brought car to us that oil spilled and that breaks squeaked.Manny the mechanic repaired , oil was not oil it was tire armor that our car cleaner uses to shine rims. We did not hear from party until one week before it was time to pay for sales tax and tag fee.Stating that vehicle shut off on November 5,2013 I explained that they still had warranty on car and mechanic would gladly fix for them, they rejected stating that they would bring car to us same day.I again called on November 6,2013 stating again that it was time to pay sales tax and tag fee like it was mentioned on day of initial sale ,They again stated that vehicle would be returned to us same day. Vehicle was returned to us on November 8,2013 with over 2,000 miles.Clearly showing that vehicle was in condition to run. Therefore we are rejecting this claim."
