Statement of Claim
Claimant says:
"On 7-19-12 my vehicle was towed. I asked them to release my vehicle to GMAC INS. The office person Debbie was very rude so I asked to speak to a owner or manager she said there is none. I asked who was in charge she said no one was in charge. I then called aaa roadside service to complain. AAA said motor body inc. was not authorized to do any roadside service for AAA. there is another name they are billing AAA under owned by the same person, but motor body inc. does not have a station number to do work for AAA. On7-24-12 I went to pay motor body inc. for the tow, they would not accept my aaa card for payment. They said I was not covered because my vehicle is a motor cycle. This is not considered a motorcycle because you do not need a motorcycle license to legally operate it anywhere in the u s a. This is motor body inc. way of trying to punish me for finding out their dirty billing secrets. They also have stored my vehicle in a uncovered area. They would not allow me to see my vehicle or get anything out of the box on my vehicle. I have been given 3 different prices on the tow. I do want this posted so others can see if they choose to use a business that lies at all costs"

    All of the following is known to David Gordillo

    Alongi Brothers is a AAA Contractor

    Motor Body performed the tow commercially – not under the AAA membership

    AAA does not cover motorcycles under the terms of their membership – vehicle is a Harley Davidson 3 wheel. License needed to drive is not how AAA determined vehicle type. This vehicle is sold as a motorcycle.

    AAA has already explained this policy – AAA is makes the rules on their roadside service not Motor Body / Alongi Brothers

    The customers insurance, GMAC INS. is responsible for the tow and charges – not AAA. AAA will not pay us for this type of service. No money is due out of pocket from David Gordillo.

    We are not required to store any vehicles under covered areas – we have limited covered storage in our lot for vehicles of this nature. This storage was already at capacity – due to this and the size of his motorcycle, the motorcycle had to be stored uncovered.

    Vehicles are available for property removal M-F 8 to 5pm with proof of registration and an ID verifying they are the registered party.

    Vehicle storage increases per day. Perhaps this accounts for the changing prices.

    There are no “dirty billing secrets”, and we are not punishing David Gordillo for “exposing” anything whatsoever. As a side note - Debra is of no family relation to the corporation.

    There are many insulting assumptions in this complaint. We have made every attempt to explain this situation to the best of our abilities on many separate opportunities.

    If David would like to discuss this issue again, we would be happy to do so. We have two managers who administrate complaints and issues. Mr. Gordillo may contact John or Ray on this matter. We would like to request that should Mr. Gordillo decide to contact us, that he refrain from using foul and abusive language.

    Threatening to publicly post unsubstantiated / unverified claims against a legitimate business unless it receives a response to on it's web site is appalling.

    Way to encourage acts of libel. Defamation. Look it up.

    Further, charging an individual money to post a complaint and then encouraging the individual to "settle" with the company for your fees is despicable to say the least.

    This will be our last contact with the site or the party that posted the complaint via this site.

    We will not respond to any attempts by peopleclaim.com to "arbitrate" this complaint.

    Certified cease and desist letters have been prepared.

  • Excuse me, but we are not aware of anything missing from the vehicle in question. I have no idea what a "Sony ePak EX3500" is - nor was it ever mentioned. $5,000.00?!?

  • that was a mistake about the sony e pak.the 5000.00 was not.your lies to me and the lies to code enforcement,not keeping the vehicle in a enclosed area,3 different tow fees on the same day quoted to me ,the problems about haveing the vehicle released,harrasment,etc.has everthing to do with the money.you are going to be held responseable for what your company has done.I want to hear from someone in charge not debbie

    Code enforcement denied your claim because a public agency was called.

    3A told you that your tow was not covered under their policy.

    Yes you had a choice.

    3A would not allow you to place this tow on your card. At that time you had TWO choices. Pay your tow bill out of pocket or let your FULL COVERAGE INSURANCE claim the vehicle. This was explained to you many times by no less than 2 different people.

    You are angry and frustrated because you were not allowed to place the tow on your 3A card for whatever reason you wanted to do that.

    Your vehicle was picked up by your insurance company yesterday.

    I'm sorry you feel that wasting more time filing in small claims is the only way to resolve your anger and frustration with our company.
