Statement of Claim
Claimant says:
"On April 10th, 2018 I paid Dr. Molano 1035.90 for a crown. She sent me to Dr. Daniel Newbold to prepare me for a long crown. It took several months to finally receive it and it was short with a hole in it. Molano said she would send it back.

In the mean time I went to my new denist to see about the one she had cracked, I didn't think he could do anything, but he took Xrays and told me my tooth was fractured at the gum line (that's the original tooth) and would have to come out. Now I'm looking at big money for an implant. I called and stopped Molano from doing any more to the crown, because now my tooth has to be pulled. Molano wrote me a letter saying I should find a new dentist that she didn't feel we had a good relationship. I wrote Molano back and ask for my money back for the crown 1035.90 on july 23rd, and have had no response. I also paid 25.00 for my records and ask if I could hand carry them, they told me they would send them to Dr. Garcia.

Dr. Garcia's office has requested them at least twice. The last person said they had already been sent and they had no more of my records. (Gwen) the person who was taking care of this I find out has quit Dr. Molanos office. Dr. Newbold told my dentist Dr. Garcia that he would be glad to refund me my money because he doesn't know which one of them might have done it, he's prepared me for an implant at no cost and I think Molano should refund me my money for a crown I didn't get so it can go toward my implant.

  • When Judith was seen on April 10th 2018 It was made clear to her that she would have to see a specialist for crown lengthening due to caries 2 mm beneath the gum line and periodontal issues. During my exam there was no fracture present on the x-ray. The specialist did not see a fracture either. Once the crown lengthening procedure and healing was complete, which took 5 weeks she then returned to have the permanent crown cemented. She was not happy with the look of the crown, and after explaining to the Judith that the crown was made to prevent future caries and periodontal issues, she went against my diagnosis and insisted we add porcelain for aesthetic reasons. At that point the crown was returned to the lab per the patients request, and was returned to us 8 day's later. Shortly after Judith called to request a record transfer to a different dentist. She completed the necessary form for us to send x-rays. I sent over an email containing any digital copies and placed her film x-rays in the mail as requested by Judith. The address Judith provided was not accurate so they were never received. We have been in contact with this practice to work with locating these records. At this point I took the proper legal steps in dismissing the patient from our care. A letter was sent to the patient letting her that we strongly believe that a successful doctor patient relationship is key to being able to properly treat patients. I stated that I would be available to in case of an emergency. I went above and beyond to accommodate Judith, as I do with all of my patients. It is unfortunate that this situation has escalated.
