Statement of Claim
Claimant says:
"Marak Ind., Inc. told me that for $1500.00 they could get me a "loan modification" with Litton Loan Servicing, LLC of Houston, Texas. They got their $1500.00 through withdrawls from my bank account of $500.00 each. The paperwork was signed on April 15, 2011. Deductions were to begin on the 21st of each month thereafter.

They stipulated that the process would take between 39 & 90 days from receipt of my application. On June 21,2011, I sent a fax stating that I had not heard from anyone from Marak Ind., INC. and that I feel that I should be refunded the $1500.00.

Then I was contacted and they said they needed more paperwork. I submitted that. Still no word from Marak Ind., Inc. After a few more faxes, emails and phone calls, I received information from Gabrielle Mackey stating that she had talked to Litton and that Litton said no to the "loan modification". I asked for a refund of the $1500.00. She said they do not give refunds. But, a statement in the paperwork that I signed says that I could get all but a retainer fee refunded.

The mortgage is now in the hands of Ocwen Loan Servicing,LLC and they do not offer Loan Modifications. I need that money back."

  • She states that I was hostile and rude to all her employees. If that is true, I had paid the $1500 and got nothing in return as far as a modification. I am no longer with Litton Loan Servicing. I am now with Ocwen Lending Services.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "This claim is outright false. This client breached our retainer agreement on multiple occasions and is now attempting to extort money through slander.

    He did NOT pay the amount alleged in the complaint. In fact, bank fees were accumulated by Marak through his misrepresentations. He ignored our attempts to collect required paperwork. He was hostile and rude to ALL of my employees. He failed to tender documents timely and in total.

    He is not entitled to a refund nor will one be forthcoming. Farrand and Marak entered into a written retainer agreement which detailed the duties and responsibilities of each party. He breached said agreement on multiple occasions.

    PeopleClaim.com are interfering with this retainer agreement. Remedies are provided for at law and in equity under the terms of our retainer agreement. As such, PeopleClaim.com are open for liability in civil court for damages under a claim of tortious interference of a contract. "
