Statement of Claim
Claimant says:
"On June 21, 2012, I took my '02 CLK Mercedes Benz to have the tires checked due to my front end shaking and the front-right tire was leaking. The Attendant asked me if I had my receipt, so I looked in my car for the original receipt but couldn't find it. So I went home and printed out proof of purchase from my bank account that I purchased tires on 4/4/02 in the amt. of $109.00 debited to my check card.

The Mechanic checked my front tires and then took the front-left tire off and took it into the shop while I waited inside my car. He put the wheel on a machine, he came back about 10 or 15 min. later and said that my wheel was bent. I asked where and how could it be bent, he said maybe you ran over a bump. Then I asked him how much? He said no charge. As I was driving off, I noticed that the wheel he replaced had a lot of black grease or something on it. On Saturday morning, I went outside and washed the black tar-like substance off the wheel and I noticed that this was not my original. This wheel was different from all of the other wheels. I then took my car back to Madrid Tires, Inc. and spoke to the Attendant who was in charge on Thursday (6/21/12). I told him that the wheel that was on my car was not my original wheel and that I want my wheel back. He said speak to the manager, Alex. I spoke to Alex, he looked at the wheels and asked for my receipt, I told him that I didn't get a receipt on Thursday because the guy said there's no charge. Alex walked around for a while and pull and replaced tires on other cars as they just had me standing there and waiting for about 30 minutes. I then asked what are you going to do. Alex spoke to the mechanic, who was responsible for swapping my rim and he denied swapping it. Alex went and got a Mercedes-Benz decal for the center of the tire and put that in to make the rim look like the other 3 rims. I told Alex that I've had my car for years and that I know my rims and that I would have to talk to an attorney if they didn't return my original wheels. Alex said get a lawyer, we have cameras, and you don't have no receipt. I stated to Alex that I've been a good customer in the past because I buy tires from them for my 12-passenger Ford Van and for my car. Therefore, I deserve better service than this. I explained to him all I wanted was my original rim that came with the car put back on my car. He looked around and said that he can't find another rim like that and for me to take him to court because I don't have a receipt. I told him that I do have proof of doing business with you and that they have lost a good customer do to their crooked practices. I left without them returning my original rim and I would like my original wheel back because the one that they put on is different. Those Mercedes-Benz wheels are very expensive and I want the return of my wheel."

  • All the transaction between Madrid Tires Inc. and Christine Wade is caught on camera and at NO point during the whole process was her rim switched, exchanged, or altered. The service provided during her second visit where rim was re-balanced and re-sealed was provided FREE of charge even though she had no receipt. Madrid Tires is willing and able to take this matter to court if she so desires although all the evidence clearly shows NO wrong-doing on Madrid Tires Inc's part.
