Statement of Claim
Claimant says:
"I was At Their auction on 6/20/12 Looking to buy cars on that date i bought a car that was rep by other dealership that had a rep named Pete who rep the car for Lynns Nissan West of 59 route 206 Stanhope nj 07874. It was a 2002 Kia Sportage vin #kndja723825149831 it was sold title attached, so the very next day i took this kia for inspection. The frame was so rotted it could never pass so I got in touch with the auction, they told me to bring it over so they can check it out . Then a few hours later I was told I had to keep the car or never come back to the auction. I stayed away till on 9/1/12 till i had to meet someone there and I was met by Pete WHO ASKED WHY I CALLED LYNNES NISSAN WEST ABOUT THIS WHICH HE SAID DOING THAT ALMOST MADE HIM LOSE LYNNES NISSAN AUCCOUNT sO I ASKED HIM WHY HE SOLD ME A CAR THAT SHOULD HAVE BEEN IN A JUNKYARD AT THAT TIME. HE SAID I WAS A WISE GUY AND GOT JERRY ONE OF THE OWNERS TO TELL TO LEAVE OR THEY WOULD HAVE ME HANDCUFFED OFF OF THE PLACE SO I LEFT BUT IF THERES ANY JUSTICE YOU THINK THE STATE POLICE AND DISTRICT ATTONEY OFFICE WOULD CHECK INTO THIS. I LET Pete And Jerry Both Know That I m GOING TO GET IN TOUCH WITH THE DISTRICT ATTORNEYS OFFICE BUT THEY JUST LAUGH ABOUT IT AND SAID DO WHAT I NEED TO DO"

The claimant's settlement terms were rejected with the following explanation:

    "Mr. Sorrentino is a used car dealer. He is not the owner of MJM Auto Sales, just an independent buyer. He has been doing this for nearly 20 years and is very experienced in vehicle buying. The vehicle in question was purchased AS-IS with all faults included frame problems in an auction environment for junk yard price.
    He gave us a non-negotiable check which is against auction policy. This is why he was stopped from doing any further business at the auction. He then showed up on a Saturday sale like nothing happened and was asked to leave. He has since called Lynnes Nissan and threatened them wilh legal action if the didnt take the car back. HE NEVER PAID FOR THE CAR OR CONSUMATED THE AUCTION TRANSACTION. The car was resold to someone else who is very happy with the vehicle. This was not the first time Mr Sorrentino violated auction policys by choosing not to pay for a vehicle. We do business by a strict policies and procedures guidelines and have done so for 20 years. It is fair for both the buyer and seller. This whole claim is about a vehicle he never paid for and never owned. He never suffered a loss since he never took ownership or exchanged any money. Dealers who purchase as is vehicles expect to make repairs so the vehicle can be resold at a profit. It is as-is because it has problems, and the price reflects the condition. "
