Statement of Claim
Claimant says:
"Hello, My name is Stan Little. On Dec. 4th my self and my friend, Donna, went on a bus trip to New York City to see the Rockettes Christmas show. Due to poor instructions by the bus driver we were at the wrong pick up point. It was not only us but a mother and daughter were also at the wrong place. I've copied and pasted the following days e-mail with King Ward.

At first I just wanted restitution for the cost of the trip and the additional expenses to get home but after King Ward's failure to accept responsibility for their bus driver I intent to ask for more.

Donna,

First off I am sorry that your trip did not go as planned.

We have spoken to the driver and there appears to be some conflicting accounts of what happened.

Without pointing fingers at who is to blame, I would be willing to offer to reimburse you $100 towards your additional travel expenses.

Please let me know if this acceptable and I will send out a check to you today.

Subject: NYC Bus trip Dec. 4, 2012

Good Morning:

I am writing to you in regard to a recent trip to NYC on your bus tour December 4, 2012 . It was a gift from Stan Little. The day was wonderful. I cannot say that for the evening. It was like “Trains, Plains and Automobiles”. Your driver was not specific in his directions and he did not give us his cell phone number. The would’ves, should’ve and could’ves are done with here. It’s my opinion that your company should have a policy in place where your drivers better prepare your passengers before leaving the bus. In this case that did not happen and we were told the wrong area. We were not the only ones. Another couple, mother and daughter were also with us until we were separated looking for the bus.

I am a disabled veteran wearing prosthetics and cannot walk long distances. We walked the three block area between 49th and 51st Streets for 45 minutes until I was in so much pain we made the decision at 6:41 that we missed the bus and took a taxi to the port authority, luckily caught the 8:00 bus to Albany and then took another taxi to Pittsfield .

In my opinion, restitution should be made for this unfortunate inconvenience of the additional cost of $177 out of pocket Mr. Little paid for the travel home to arrive at 1 am then to have to get ready for work at 5:30.

I want you to know that I will not bad mouth your company. I just will not recommend your company.

Thank you for your attention and consideration in this matter.

Donna Freed

Dennis,

I found the mother and daughter who were at Wells Fargo Bank with Donna and I.

Your bus driver is a liar and they will back us up on that!

He never gave out his cell phone number!

When Marlene and her daughter got on the bus they were really upset with your
bus driver.

They told him where we were waiting and told him just to drive to the Wells Fargo Bank where we were waiting.

He refused and said he was late already and left.

Other passengers were also upset with his actions.

I expect full restitution for my expenses plus the $250. for the trip for poor service of your bus company.

Unless I hear from you tomorrow, I plan to report you to the Better Business Bureau and to take Ward King to Small Claims Court.

Marlene and her daughter said they would be witnesses for us.

I'm re-tired and have plenty of time!

You have no idea how much business you have lost because of your arrogant bus driver.

I'm sure all the passengers on that bus will be telling friends and family about Ward King!

Why don't you just man up to the fact that your bus driver screwed up and be done with it.

You don't know me but when I know I've been screwed,I'm like a Pit Bull and won't let go!

Merry Christmas,

Stan

Dennis.
I don't know what the confict would be.

If we were the only ones standing in front of the Wells Fargo bank,I would have said we were the ones who screwed up.

But we were not. there were other people there also.

The bus driver said he does not give out his phone number.

We were one of the first to get off the bus and we asked where and when we leave.

He said the bus would be in front of the WELLS FARGO BANK AT 5:30PM.

We asked at least six Police Officers were the Wells Fargo Bank was and we got the same answer from them.

Maybe the bus driver was more specific to the rest of the passegers after we got off.

We like taking day bus tours and have taken many trips with with Dufour Bros. and never once have we had this problem.

We were originally going to go with Yankee Trails to go see the show and my nephew,Chip, who is a mechanic for Dufour Bros. recommended King Ward.

I feel if you want to keep us as future customers, you should pay the $177.00.

If you don't care for our future business, just send the $100.00 and we'll
be done with each other.

In my mind it is definitely King Ward's mistake.

  • My guest for the trip was Donna Freed. She is a disabled vet who seved 15 years in the U.S. Navy. She served in the first Iraqi war and the Bosnian Conflict.due to injuries she received while in the Navy she wears braces on both legs. After walking several blocks she could no longer walk. At that time we took a cab to Port Athuority to catch a bus. Her ankles were so swollen she could not remove her shoes and was in great pain.
If this goes to court, you will lose.

  • Dec 13, 2012, Claiming party added:
  • Due to your lack of consideration for a disabled vet,I know will change the amount to $50,000 and will hire a lawyer who only charge me for a percentage of the claim.I have nothing to lose.
I first just wanted to get the $177.00 for expenses to get back to Pittsfield than i found out we were not the only two given bad instructions and are willing to tesify that when they found the bus they told the bus driver we were waiting just around the next block and he told them he was already late and took off without us.
I don't know what your defense would be! Stan Little

  • Stanley Little ToDennis That was before I found the Mother and daughter who finally found the bus and told your bus driver where we were waiting and he intentionally left us there!

Right now she is typing her and her daughter's frantic search to find the bus and what the bus driver said once they found it.

    What's that called? New Evidence!!

Due to your lack of repect for a disabled vet,I will continue to push this!

I can't wait to see what the court thinks of your company leaving behind a vet!

    YOUR SCREWED!!
Oh by the way,I used the $100.00 to go back to New York with equipment for the Fire Depts. that were devastated by Hurricane Sandy. I've gone there twice with supplies. Thanks for your donation!

I'm in the process of contacting a lawyer.

Maybe he will think $50,000 isn't enough!

I'll bring that up in court also!

    See you in court!

  • You mentioned in your claim that you were thinking about contacting an attorney. I think an initial legal consultation would be beneficial to you, so you can find out about your potential rights and remedies in this situation. Hopefully that will help you decide your course in this situation.

  • I have only taken one tour like this but I was handed a piece of paper with a street address and map for the meeting place plus contact information for if there was a problem. I am surprised that a tour would not do this. I would think that this company owes the gentleman an apology if this was not the procedure.
