Statement of Claim
Claimant says:
"In March of 2012 I purchased a diamond engagaement ring from the Ann Arbor store at Briarwood Mall, Michigan.

The certificate I was given from Kay at the time I purchased the ring rated the primary stone as one karat. When I showed the ring to a few people, it was suggested that the ring may not be one karat. I took it to three places to have gemologists appraise the ring out of concern I was sold something other than a one karat. The apprasials all indicated the ring was only .87 karat ( signigicantly smaller for a diamond) , so I took the written apprasial to Kay to rqueset a refund. The assistant manager was extremely apologetic and stated he would refund my money. Since it was past the normal refund deadline he had to call customer care to approve. Customer care wanted me to give the ring back to Kay so they could appraise it. Since they already appraised the ring before sale and put it in writing I refused and insisted on a refund. I was told it is against company policy to refund after the refund deadline. I asked isn't it policy to provide the merchandise that is advertised?

Again the assistant manager agreed with me and called the district mamager. The DM only offered an exchange, which I refused. I thought I was buying a one karat diamond and was sold a diamond much smaller. This is false advertising and I will only accept a refund of my money. The price was also 2,000.00 higher than the highest apprasial (including the retail apprasial). To date, Kay Jewelers is refusing to refund my money."
