Claimant says:
"The windshield on my EZ-Go evidently was not secured properly when they picked it up and it blew off the unit in transit. They did not tell me the unit was destroyed on the way to their shop but a friend saw the cart when the driver pulled over to check it out. He called me and told me that my wind shield got destroyed. I waited for three weeks for the EZ-Go to be repaired and called the shop numerous times to check on it, not one time did they mention the wind shield. They returned the unit yesterday. The driver just dropped it off and left, did not even let us know he was here. They put an old wind shield on it that was scracthed up, has no brackets on the top to keep the wind shield in place and is duct taped in the middle. If they had told me about the wind shield while they had the unit I would be a little more understanding. But since they tried to pull a "fast one" on and old 76 year old senior citizen I am furious! "

  • Please do not interpret the following comment as my being unsympathetic. I have been on your end of these types of disputes and it surely left a sour taste in my mouth. However:

    From what I am understanding, the windshield was not secure when picked up by J&R. Though you do not say whether the $315 paid was related to the windshield or not, the facts as presented suggest J&R did not cause your damage. Beyond the fact that J&R had nothing to do with the windshield being unsecured, you knew about the windshield, spoke to the shop multiple times over several weeks and made no mention of it -- you cannot be swindled when you are aware of the facts and circumstances at hand and choose to take no action. In other words, you had the ability to potentially change the outcome and instead waited to be damaged (if you did, in fact, suffer any damage). Unfortunately, I do not believe this to be a viable claim.
