Statement of Claim
Claimant says:
"I contracted with Iron Mountain to store my meedical records when I retired from my clinical OB/Gyb medical practice at the end of 2005. Since then, I have continued to promptly pay my monthly storage charges consistently (usually in the $135 to $165 range). When additional fees were incurred due to retrieval and sending requested specic records, I was customarily promptly sent an invoice for these extra services. These extra charges (usually less than $200) were always promptly paid. However, in the middle of 2008, I was sent a PAST-DUE invoice for $1927.36 with no indication or explanation of this extra charge and PAST-DUE invoice. I made numerous written and telephone requests for an of the basis or reason for this past-due invoice for $1927.36. In spite of these numerous requests, I was NEVER given a reason for this PAST-DUE invoice until I was informed by telephone 3 years later, on 10-11-11, that the extra charge was related to a subpoena. Iron Mountain consistently refused to respond to my requests for explanation or documentation in writing until 2011; they would only respond by telephone, and even by telephone avoid explaning the reason for the $1927.36 PAST-DUE charge. During a telephone call to Mrs. Kim Reimer at Iron Mountain collections department in 2009, she informed me the matter would be completely resolved if I paid $846.31. I promptly sent the $846.31 payment on 8-22-09. I did not hear from Iron Mountain again regarding this matter for almost a year later, when they again began sending me PAST-DUE invoices for $1091.50.

Soon thereafter, I again made numerous written and telephone requests from Mr. Ralph Schellenger and Mrs. Robyne Mairer at Iron Mountain collections department for the reason for this past-due charge. I finally received an e-mail message on 12-8-11 from mr. Schellenger detailing the charges related to a subpoena in 2008 ( 3 years earlier). I reminded Iron Mountain I was NEVER informed of a subpoena until 10-10-11 by telephone. I NEVER resisted complying with any subpoena involving me or my stored records with Iron Mountain.. Even so, it was not clearly explained why response to a subpoena should cost me the extra $1927.36.

In light of my prior 3-year effort to fairly resolve this matter, I feel the persistent demand from Iron Mountain is unjustified and unfair.
