Statement of Claim
Claimant says:
"I entered an agreement with said co. for a steel building. The arrangement I made with the salesman was contingent upon my moving to a new address. I have had unforseen problems with my move. I still rent and have no address to send the item to. They have taken what they call a non refundable deposit for blueprints which are part of the package that was to be determined after I purchased a property. The salesman said they could hold off on delivery until I obtained my land. The officer in charge of their business says I have to take delivery and they want my address or they will keep my deposit plus the balance to make up 50% of the total cost and I will receive nothing for my money. I would have been content to hold off the balance until I obtained a new property but they are uncooperative. I did some research and they are under their third name recovering from two f rated businesses and that they hide behind the non refundable blueprint deposit stating that it is expensive to formulate a set of prints for a designated property. Therein lies the problem. I have no property to deliver to or render blueprints on yet. They have no evidence of a set of prints to hold my deposit for. I am requesting they refund my deposit now that I have seen what they are.I have over 50 pages of bbb complaints against them. On my contract it lists the blueprints as part of the package. They have none and it says on my contract for delivery TBD.[to be decided].I am requesting the cancellation of my sale and refund of my deposit due to the fact that they can't produce my package. The fault if any lay on their salesman which they say to everyone has nothing to do with the contract. He had no business selliing me a product that they could not complete in the first place."

  • Please note that to date, there are excessive costs incurred with regard to Stumbo’s order. Immediately after placing his order, Stumbo’s custom blueprints were drafted. Please be advised that blueprints drafted for each building are significantly different and are not “stock items.” In fact, each blueprint is custom drafted per a customer’s exact building location and loading requirements. Prior to Stumbo’s engineering being drafted, an engineer from International Buildings contacted the appropriate zoning authorities (this includes city, county and state zoning authorities) in order to verify all appropriate loading requirements. It is after that task is completed that the appropriate structural engineering and concrete drawings, with appropriate steel reinforcements, can be drafted. Immediately after drafting Stumbo’s custom blueprints, they were sent to him. Once again, the blueprints drafted by an International Buildings engineer are extremely time consuming and are therefore very costly. Stumbo’s blueprints were custom designed and drafted per his site specifications and can only be used for that location and can not be provided to any alternate future consumer.

It is for this reason, the fact that custom site-specific engineering is drafted for each order, that each contract Stumbo executed reds in bold capped letters in pertinent part: “NON-REFUNDABLE BLUEPRINT DEPOSIT.” Accordingly, the previously tendered deposit made by Stumbo to International Buildings is non-refundable.

Please be further advised that International Buildings stored a building for a period of 6 month time for no additional cost. Regardless of the fact that Stumbo’s storage fee should be $250 per month for any time in excess of the already contractually agreed to 6 month time frame, International Buildings offered Stumbo storage for his building for only $100 in order to assist him. Stumbo claimed he wanted free storage or a full refund, despite the terms that he already agreed to in his contract. He then claimed that he would defame International Buildings to the media and each and every private and/or government organization possible. Stumbo was explained the cancellation policy, per the contract he executed. He then elected to cancel his order and profusely swear at an International Buildings vice president.

Please also be advised that Stumbo’s contract reads in pertinent part: “Upon cancellation of order, Buyer and Seller both agree that 50% of the total price equates to probable damages suffered by seller, and shall be paid by buyer to seller immediately after cancellation of order.” Accordingly, there will be no refund of any of the previously tendered deposit. Demand is hereby made to Stumbo for the balance of the cancellation amount for cancellation of the order. That amount was not paid by Stumbo to International Buildings within the timeframe given to him so his file was accordingly sent to collections.

This is strictly a contractual issue and Stumbo must abide by the cancellation terms and conditions of the contract he executed. As Stumbo expects International Buildings to abide by the terms and conditions of the contract, International Buildings expects the same from Stumbo.

Should this matter not be resolved amicably, International Buildings will immediately exercise its legal rights to the fullest extent permitted by law, including but not limited to bringing a legal cause of action against Stumbo in Broward County, FL.
