Claimant says:
"my name is Daniel Madry phone 570-403-1444 cell 845-325-6613 . I payed for what's called occupational heath insurance. This is insurance for owners of small businesses where you do not qualify for workman's compensation because you own and lease the work from other companies.work. So I payed them Inter -Americas 150.00 a month to cover in case I was hurt on the job. Well after about two and a half years working I hurt my neck/ and or shoulder. I reported it to the company I was leased to and also the Inter America ins. The company I was working for fired me and told the insurance company the wrong date. I was hurt on Sept. 16, 2015 and Kane Is Able said it was Sept,21, 2015. This gave Inter America an excuse to not pay for my treatment and the missed work. After being out for a month and not getting any compensation, I was forced to go back and work hurt. I crashed my car into a curb because my arm could not turn the wheel. I drive a tractor trailer! So I am driving injured now. Have not been payed any money , refused an MRI from my health insurance because its a work related injury. Also Inter Americas told me I could see a rehab facility and a chiropractor and they would pay for that. So I did go for treatment and neither the rehab or the chiropractor have been paid. They both told me that the insurance company keeps asking for bills and they keep faxing them and they still have not payed. I visited a surgeon and was told my injury is in my neck and I need an MRI. I am not better and would most likely still be out of work or recovering from surgery so besides them owing me 700 a week for three weeks they may also owe a lot more if I need an opperation.   • The Money listed is not correct. I am owed 2100 missing one month of work. I am getting an MRI so depending on that result I may or may not miss additional time. So far I am happy with the way things are going

  • Both dispatchers Mark Stephen and Gregg Manley from Kane know that I got hurt on the job there is an electronic logbook so they know exactly the day that it happened and that I was on the job. This is just another way that this insurance company is avoiding paying this claim and they know that this is their responsibility. I will do whatever it takes to go after them even if it means getting a lawyer

  • It may take me a little time to go through my text messages . I texted Kane about my injury . I also reported inter America to the national insurance regulators in Washington DC ! I believe between peoples claims and the insurance regulators they will make the right and just action and make good on my claim

The claimant's settlement terms were rejected with the following explanation:

  • "Mr. Madry reported a loss that we have been unable to confirm. Between claimant and medical notes, we do not have an exact date and his motor carrier will not confirm dispatch. This is an occupational accident policy only and benefits are based on the confirmation of having been working at the time of loss. Unfortunately we have been unable to confirm the loss. We are therefore covering Mr. Madry's injury under the non-occupational benefit (a lesser benefit) which covers medical only at this time. Claimant has other insurance which is primary. Further investigation continues. "
