Statement of Claim
Claimant says:
"Paid in advance and requested a smoking room at a hotel that has smoking rooms available. After assurances from Hotel.com agent, I booked the reservation and paid for 2 nights in advance. When I arrived at the hotel to check in, I was told that no smoking rooms would be available either night of my stay. The hotel policy was to charge a night's room and tax for reservations cancelled after 6pm. I checked in after 6pm on 9/16/11 but told the hotel staff that I would have to cancel for the 17th if no smoking room became available. I checked out on 9/17/11 and was told that no smoking room would be available that day either. So, I cancelled my reservation for the 17th and was told that I had to go thru Hotel.com to process any refund for the stay of 9/17/11. When I contacted Hotel.com about a refund, I was told on 9/17/11 that I had to wait until 9/19/11 to process a refund because the hotel manager had to OK a refund and would not be back until then. I called Hotel.com on 9/19/11 and was told that the hotel manager refused to OK a refund for the cancelled stay of 9/17/11 because they were not obligated to reserve a smoking room for my stay and that I cancelled after 6pm on 9/16/11."

A wonderful serenity has taken possession of my entire soul, like these sweet mornings of spring which I enjoy with my whole heart.
