Claimant says:
"Homevision came out and gave us an estimate to replace our windows and front door. we have a homeowners association and all work have to be approve before any work is done. I was told by the salesman they had done a lot of work with the association that they would submit the request for us. I told the salesman because I was on oxygen I wanted the work done before December and we could take advantage of the tax credit. He assured me that it would be done. I told him the contract was pending until approval by the association. Because of several issues that occurred between their company filing and the association but non from our negligence and no measurements was done and undue stress from their company we requested our total refund. They have refused to give us our refund back."

  • Our position on the matter is the same as it has been for the past year. We have completed the necessary paperwork per the HOA terms and submitted it for approval. We have not heard anything since and our contract does not state that we take responsibility for gaining approval. Our role in the process is to provide the necessary description of work and to understand the guidelines - which we completed. We have always maintained that we will complete the project to the contract specifications once we get the approval from the homeowner which has yet to come. Nowhere in the contract do we state that the contract is contingent upon approval or that the homeowner can cancel beyond their recission period. We are working well within our rights as per the contract.

Message from Home Visions: Our contract with you has the name of the HOA and according to our records we did complete the application and submit it for approval. Typically, we send the information back to the homeowner for final approval, signature and submission since the HOA typically does not deal with contractors directly, rather they like to deal with the homeowner. We do not take responsibility for lost applications or denied applications. We are willing to resubmit the application and begin the process again and complete the job per the contract, however nowhere in the contract does is say that the agreement we have is contingent upon receiving the HOA approval or that you may cancel out of recission with no penalty.
