Statement of Claim
Claimant says:
"In February of this year I purchased a bath unit from them. They contracted with a person from Atwater to install the unit. He installed the unit and removed from my home three sheets of marble, one bath tub and a hand held shower head and fixtures that were in very good condition. I did not realize that he had taken these items until after he departed. I contacted the person who had sold me the bath installation by registered letter, email and by telephone. I explained to him what had occurred and asked for the installers name so that I could make a police report. He did not disclose the name of the installer but had him call me. I asked him to return the items and he said that his helper had heard me give the items to him. That was blatantly false and he knew it and refused to return the items. The person who sold me the unit has not returned my calls nor provided me with the information of his employee. I am unable to make a police report and I don't have any other recourse to resolve my loss."

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "Mr. Pundt contacted with our company, Home Safety Baths to remodel their bathroom. Our contract included removal of their old bath tub and bathtub wall material and fixtures and install a new shower pan, new wall material and new plumbing fixtures. Because the removal is part of our contract we require our installers as part of the job to remove this old material and dispose of it. Since the demolition of the old bathroom is done on the first day of the job, unless it is expressly written in the contract that the customer wanted to keep something or informed the installer on the first day of the job of this, the installer should have disposed of it as required. On completion of the project Mrs. Carol Pundt signed our Installation Satisfaction Certificate which states a number of things including "the installers cleaned up to my satisfaction on completion" All old materials from the bathroom would have been disposed of, since we never reuse old bathroom material for sanitary reason. And for the same reason there is very little value to this material.
    I would like to reiterate that we did exactly what was called for in our contract and without prior notification from the owner that he wanted to keep the old used material we would dispose of it and it is difficult to return old material that has been disposed of.
