Claimant says:
"Depo Dynamics was hired by Mr. Herman Franck on multiple occasions to provide court reporting services. Mr. Franck has not paid our invoices to date and owes Depo Dynamics, $15,000. He is also in breach of agreement along with his client, Carlos Gutierrrez. We have made numerous attempts to collect and he has ignored all attempts to collect to date after nearly two years. He says he does not have money but anyone can look on the internet and see he is a published author who is enjoying a very nice rich life off of the innocent. He lost this particular case for his client because of his lack of skills, desire and attention to the Gutierrez case. He will take your money and travel around the country charming everyone out of their money to listen to him speak or buy one of his books! The people should be ware of Herman Franck, practicing law in Sacramento, CA. Other Court Reporting Agencies should be put on notice of Herman Franck and Franck & Associates. He will not pay your bill, nor will his client, who also is in breach of agreement with us and owns and operates Food Beverage Handling Schools/Restaurants in CA."

  • The nature of the contract dispute requires professional, detailed knowledge of both the language of the terms of the contract as well as the applicable California law. California law, after research, has a cap on their small claims courts of a demand of $10,000, and no cap on claims brought in regular civil court. Both courts (civil and small claims) do have alternative dispute resolutions systems set up if you would rather participate in a mediation or arbitration of your claims. Because the named party has not participated in this process or responded, and you have filed similar complaints with no response on other websites, it may be more beneficial to file a court action and see if they respond, either through this forum or the court.
