Statement of Claim
Claimant says:
"I Hired the owner Humberto Castro to install wrought Iron on my new home. I paid him half up front of what he estimated me at and told him the remainder would be paid at the time of install. He then came a couple of weeks later and told us he made a mistake on the price he had estimated me at. He had said he forgot to add the front screen door in the price and the computer caught the mistake. We came to an agreement that he would add screen to my side gates for the inconvenience and we would agree to the new price. Well several weeks later and numerous calls from me he finally showed up to install. I had to leave for work at the time so i left the payment with my father and told him to pay him when the job was finished if everything looked good (which he did pay the remainder to Mr Castro)The next day in the sunlight I noticed several things wrong with the wrought iron after install, he said he would come back and fix them it was damage done when they installed. I also noticed that the front wrought iron door had a couple of big dents in the screen. I called him to ask him when he was going to come and fix them and he told me very rudely that he couldn't talk to me no more about the deal he could only talk to my husband which i thought was really odd being that he had being dealing with me about the job being that my husband was rarely home. He hung up on me so i had my husband try to contact him and he didn't answer. We haven't heard from him since. I am stuck with a job i am very unhappy with and he got away with being paid in full of almost$ 2,000 dollars. If you can please help so we can make sure this don't happen to anyone else.   • While the company has responded to your claim, they are not including a lot of information as to why they disagree with your position. In this situation, you had a contract for installation of certain items, you verbally agreed to certain alterations of the contract, and the work was not performed to your liking. Because they have not been responsive to your claims here, and you are simply seeking for the fulfillment of the contract that was agreed on, perhaps speaking to an attorney for legal advice on this claim may be warranted. If you hire someone else to repair the work that was not completed, a legal consultation can let you know if have any rights and remedies available to you from work not completed or fixed.
