Claimant's opinion: Your client Rainer Vista HOA was Harassing me for money owed when they knew there was no contract or paperwork showing that I was even part of the HOA. Your the one that believed your client and filed a fraudulent Law Suit against me which caused hardship to me and my family. I know I should ask for more Damages that you and your client caused so if no agreement is made I will ask to seek more in Damages for the Fraudulent Law Suit and the Harassment from your client Rainer Vista HOA
I sympathize; it's awful that you spent money and time defending yourself against wrongful debt collection and also had problems with your credit as a result of that wrongful debt collection.
However, I think you will need to file against the HOA, not Grimm. Debt collectors and attorneys do what their client tells them to do within the bounds of the law. I doubt whether Grimm had any responsibility to verify the debt.
I would file against Rainer Vista HOA either here or in Small Claims court, or both. Some HOAs are simply out of control and many do try to collect fees from people who are not obliged to be members. In some communities you MUST pay the dues, in others you do not have to do so - documentation of any HOA obligation should have been provided at closing.

I fully understand what you are saying but I also know that Grimm Collection should have never act on a situation if they don't have full written evidence in their hot little hand before the go out and get an attorney to file a law suit and attack an innocent individual credit rating. So the question lies if Grimm Collection is a professional Debt Collector and not a fly by night Debt Collector then the Company would know to have written evidence before accepting a case and to file a law suit against an individual. For their client HOA knowing there will be repercussions and that they would be responsible for all of the damages which can and will include a lawsuit against Grimm Collection over their client the HOA doesn't have any documents such as my deed or signed copy showing I acknowledge there is a fee to pay HOA money. So I talked to my Attorney and he also stated that Grimm Collection is the one that filed the law suit against me and they are responsible for the damage and money I lost to protect myself. He also stated that Grimm Collections can go after the HOA to get back any money they lost for Attorney Fees and Damage they caused me over this false law suit. But to end this My Attorney said going after Grimm Collection is correct since they are the ones that filed the law suit and that I am doing the right thing and too this date I am still being sent a statement of money owed from the HOA even know it has been dismissed by a judge. So I gave it to my Attorney and he wrote them a letter telling them to cease sending me anything from the HOA and I don't owe any moneys per my Deed to my land. But really want to thank you for looking at my case and I am looking to filling small claims here real soon if they keep ignoring this complaint like they have been so far.
