Claimant says:
"I purchase a vehicle with them on 12/12/2015 and got a promiser to fix the convertible top, front light cap, and do emission on the car cause it would not pass. They kept pushing me back and so the car never got fix a month later .Now the note is due and they want to repossess the car cause I want pay note tell its paid.I think they doing this cause they do not want to spend the cost of fixing the car."

The claimant's settlement terms were rejected with the following explanation:

  • "First of all, We did not repossess the car. He dropped it off without any explanation. He made no payments on the car so the vehicle will now be shown as a repossession, considering that he would not pay even one payment. He owes $7061.00 for the outstanding unpaid balance.

    The vehicle top was damaged and now needs a new top replacement. The glass was blown out of the convertible top while he had the vehicle. The top was in good condition when he originally took delivery of the vehicle. The replacement top will be 1100.00 to replace it.

    He drove the car all over during his use of the vehicle and drove as far as Louisiana. He had the vehicle for more than 60 days after purchase and added 4521 miles x .38 to the vehicle at a value of 1717.98 that he also owes.

    The emissions would have been completed had he just left the vehicle here for a day. It has been completed now, since he dropped it off!

    My counteroffer is for him to bring us all outstanding amounts, mileage, and price to repair the damages totaling... $9878.98 less his down payment and pick up his car.... then we will be whole."
