Statement of Claim
Claimant says:
"I trusted a salesman at Gary yeoman ford. I had told him that I did not understand how the billing process works, so I had trusted him that he would give me a fair deal and he told me with 28 years experiences he always fair, and, unfortunately, I do not check the bill to see if he did so.
The main complaints is they charge me charged me for a new car ,and it was almost 2 years old and I paid the price as if new. IT had 5500 miles on it. I told the salesman that I had just put $4000 on my trade-in to make it a true retail value of 17,400 we called my bank. To verify this fact. So I was led to believe that I would be getting 17,400 my trade-in turns out I was only given 12,400 and, nothing was told to me about that. I also was told that I have a $2300 service contract that I did not ask for.
Total charge for used 2011 Mustang two years old, $38,000 with my credit rating at 780 I was told that I got a great deal when I complained. I've made many complaints to many people and all of them said to either I'll get back with you, but they don't I get referred from one person to the next so much went by and nothing has happened.
So three things happen I was charged for a new car when it was used. I did not get my true retail value for my car worth $4400 more then what they gave me and I got a service contract that I did not ask for approx 2300
It was in October 2012 when this happened, approximately 6 months, and every day I ask my self why do I trust people. I know that there's probably nothing I can do about it, but am hoping that maybe somebody will will never buy from them again or at least Hurt their sales because they misled me and my credit.
I went back to the dealer and talked to tony (the salesman) He blamed it on his Manager Mike.It was his doing when he seen that I wasn't questioning any thing that was going on.

  • Yes, I did meet Harold on March 23 and I might say he was a very pleasant gentleman.
    My friend and I listen to him talk and he said that there was really nothing he could do about it because I signed papers stating I knew about my trade-in value.
    I brought in papers from my bank stating that the value of my car was refinance to bring it down to blue book value 17,700. I borrowed 4000 to make this happen.I also explained to Harold that Tony [the salesman], talk to my bank and confirmed on what I said.
    I know there was wrongdoing because when I confronted Tony a couple of days later. He blamed it on his boss Mike I brought this to Harold's attention he Referred back to the papers.I signed. so no this was not what I Felt was fair. It was sneaky on Tony's part only because we had talked to my bank and he told me I was going to get the money for the trade-in. I did not look for this and I signed the many pages of paper work. . Tony knows that if he would told me that I was only going to get 12,400 difference of 4400 I would've never done the deal. He knows that because he blamed it on Mike
    I found with this agency it kept giving me the run a round
    for many months and I really have nothing good about this agency to say.I know I am going to take my loss for being so naïve.,,
    With the help of so many friends I have in life and on the internet, I want people not to get ripped off. And because of salesman's greed they lose a lot of sales. I know personally I am on a crusade against this behavior.

  • Mr. Moudry got a fair deal and signed all his paper when he purchased. Everything was throughly explained to him when he did so. Also, this car was purchased 6 months ago which leaves us puzzled as to why he is filing this claim. We tried to communicate without success. We strive to make sure everyone is happy.

  • I am asked Why did it took 6 month's to make this claim?
    I talked to many managers I wrote down all their names. At first Sent Tony and Mike a letter.Telling them of intentions if not resolved and that was to take this to the top
    of their command
    When I kept getting the runaround I knew then they have no intentions of making this right. Last time there Brought the paper from my bank.It was ignored If need be I could have bank manager [ Sarah] Verify my trade in was refinanced It was brought down to blue book value I got a !.9% and the car would of been paid for then go to my daughter in case of my demise . This was done 3 weeks prior of purchase of the Mustang.

The claimant's settlement terms were rejected with the following explanation:
  • "Mr. Moudry met with Harold Kaniaris, Mgr & Pat Peabody, Finance Mgr on 3/26/13. The contract was reviewed with him & he was given copies. Mr. Moudry owed negative equity on his trade vehicle. he now understands the contract & was give a free oil change & tire rotation. We apologized for the misunderstanding and have closed this concern. Thank you, Jan McGowan"
