Statement of Claim
Claimant says:
"I hired Mike Zipp from (Estate Sales By you) out of Denver, Colorado to do my Estate sale after my husband died and took his own life.
Mike Zipp competed the sale. It was held September 22-25, 2016. According to verbal conversations as well as emails and contract, he was to have adequate help, approx. 4 helpers to run the sale. He had himself and his son, who barely helped him. He did not have anyone manning the cash box. On Monday the 26th of September he left with all the money. He has not answered phone calls, texts or emails. He was to get 30% of household sales. He was to pay me the 70% within 10 days. I have not received any money! I have not received any invoices or statements of money collected and or expenses. He has managed to send me hateful texts and 2 horrible emails with sole intent of deeply hurting me. These are unwarranted and have traumatized me when I am barely healing from my immense grief. Mike is unprofessional and not only has harassed me with these emails, but sexually harassed me when he was at my home conducting the sale. His sexual innuendos were not asked for and his understanding of STOP went unheard. It would be helpful if he never hurt another person suffering from a loss!"

Additional Communication Between Claimant and Estate Sales By You Hide
  • Mar 09, 2017, Estate Sales By You (responding party) added:
  • Her claim of receiving no money: Jessie Stover from Montrose is her real name. Jessie/Jazzy received $7,500 in funds in her hand before we left town. All of the $7,500 generated was from our services, marketing, and effort. That’s a long way from receiving “nothing.” She’s playing victim and clearly has a lot of experience at it. Jessie Stover/ Jazzy would have receive considerably more money from the sale but changed her mind at the last minute and decided to prevent us access to thousands of dollars in inventory that she was under contract to sell.
Vinyl floors damage claim: Please have Jazzy send proof of payment for the damage on the vinyl floor that she supposedly paid to fix. I’ll send a professional over too if needed. I took plenty of pictures already. It was two men that moved this and Jazzy was right next to them. As soon as it appeared they may have left a small scuff, I wiped the mark off with a rag. Let’s see some pictures of this extreme damage or any damage. Everyone was very careful from our team. I even required everyone at the sale to remove their shoes before entering the house (BIG SIGN at door)- (Standard protocol.) Sounds like we really abused the place. It’s almost impossible to scratch this type of floor. Go ask anyone at Home Depot. Even if you get a scuff we were told it can be buffed out. (Tops maybe 50. bucks).
Here Claim: We threw everything away in the dumpster. Our job is to help liquidate items quickly and clear the house. (which we did) For sales with a larger amount of broken, outdated, or unsellable items, we suggest a dumpster to help clear out anything at the end of the sale. Otherwise, our clients have the option to dispose of the leftover inventory themselves. Jazzy made the decision for the dumpster, not us. It was given to her as a choice and not a demand. Her trash and throw always filled a 15 YARD DUMPSTER! Everything thrown away was junk or broken, all unsellable. Jazzy hovered around that ben like a mother hen. It was all junk, but that's what hoarders do. One point of the sale, she tried to convince us someone would buy her pee stained mattress. I told her that I think that is very unlikely and possibly illegal. It’s a mental sickness that some people have.
Our company works on a commission, we take 30% - 60% of all items sold. It would not make sense to unnecessarily throw anything away in the dumpster. Why? Well our company would benefit much more from the profit if it was sellable. Why would we throw away things we could have made a commission on? That is insane and makes no sense.
Her claim: We promised her a thousand-dollar deduction on her left-over items from a charitable organization claim: On the first day of the sale, we told Jazzy that it would be best to line up an organization ahead of time to possibly come out and pick up anything left from the sale that was donatable. I told her we usually work with Habitat for Humanity but she could call anyone she wanted. She took my advice and told me she called someone. Jazzy agreed she wanted any of the left-over items to go to Habitat if they were interested. When the person from Habitat did stop by and look through everything she said there was nothing she was interested in. So, with that said If Jazzy wanted a tax deduction she could have received one. Just one more thing you need: To have furniture and items that an organization wants! (Not Junk) Habitat told both of us they were not interested because all her furniture and items were dated or badly worn. The goal of the sale was to have the house clear so it could be sold. That’s exactly what we did! Even with her clear mental illness making everything worse.
Extra labor cost: As far as Jazzy being paid for “labor cost”, being at the sale was entirely her choice. All she did was chit chat with the customers and cleaned up the kitchen. (It took her three days if that says anything). There was no agreed plan or any request for her to be at the sale. The reason we are hired is for our results. A couple of her friends said she tried to get rid of everything for a year now with no results. For her to think she would charge us $35 per hour for her help is a joke. Its also an example of trying to inflated damages. Plus, we never had an agreement or even talked about that. Seriously she couldn't create value working at McDonalds! Not kidding she a talker, not a worker. Sorry, but that claim maybe the funnies thing I have ever heard in my life! We had a total of eight people that helped with this sale and never planned on her help, needed her help, or asked her to work. Jessie was told she could be there to VIEW the sale if she wished. That’s it.
Stealing the radio: Jazzy is speaking of an old CB Radio that was in her husband’s truck. We have no desire for an old worthless CB radio. But we understood the radio was very sentimental to Jazzy. I told her I did remove it from the truck and left it in the garage on the top of a self that was safe and out of site.
Our Claim: Jessie/ Jazzy collected thousands of dollars from the sale and did not report it even after we told her we were aware of it. At this point we realized she was not an honest person. It all took a shift for the worst from there.
Incident with separate liquidation co: What a surprise she didn’t bring this up, but I sure will. There is also an incident on record with a second liquidation company that tried to work with her before we did. This local business owner said she was a complete nightmare and played the victim card to the max. He has agreed to confirm his own separate experiences when needed.
Last claim: That I made sexual gestures toward her. That’s a complete and total lie! The only thing thing that happened even close to this was her taking me into a back-bed room and showed me where she does her own colonics. (Not kidding) Why not sure? So gross. Sorry, but she’s not my type. This girl weighs over three hundred pounds and needs meds/drugs to function! Not that its bad to be obese and on drugs. I’m sure lots of people out there into that kind of stuff. I am just not one of them!
Thanks for your help in resolving this matter.

  • He is a horrible person. We paid him a lot of money as well for the Estate Sale business and left us high and dry and did not provide anything he said he would do. Still trying to recover some things. His number has been disconnected and won't answer to the number below as well. So sorry that happened to you. Any resolution yet?
