Statement of Claim
Claimant says:
"I, Janice Wood, need your help as soon as possible.
Joe Falsetta from San Diego videophoned us on Oct. 28th telling us that our 2007 Rainbow machine was really made in between 2004 and 2005 after I already told him at Deaf Expo at Pleasanton Fairground on Oct. 8th that I wanted to keep our 2007 machine and didn't want to buy a new one with complete unit for $2,499.95 because that price was too high after he told me that the shampoo machine couldn't connect to our 2007 machine after I asked him if the shampoo machine could connect to our 2007 machine.
I saw the blue prize form for $1,100. off so I filled out it.
Joe told me that he picked up my name for the $1,100. off prize and actually told me that he would take $1,100 off from $2,500. on the videophone a few times while my husband Ron was with me the whole time. What he said to me was too good to be true so I have to ask him if I was right that he would take $1,100 off from $2,500 and it would be $1,400 for us to pay and he told me yes, he would take $1,100. off from $2,500. I again asked him 2nd time and he said yes.
I told him that I would agree with him and I asked Ron if he would agree with $1,400. He
said yes, he agreed. Then I told him to go ahead and he told us that he would send us a few extras like small machine for sofa, filter for our 2007 machin and a bottle of carpet shampoo and he asked us not to tell everyone about that before he filled out the contract and he asked me if he could go ahead to sign my name for me because we are in San Ramon while he lives in San Diego.
He chatted with us for about 2 hours. He told us that he sold the machines to the deaf seniors like our ages and he actually told us that he likes to sell them to the deaf seniors because they have money.
He told us that he has money problems at home as he told us that his property tax increased and increased from $6,000 to $14,000.
I have to send this to you now because I am not finished with this. My email address is janicewood@comcast and my phone nu is 925 241 4237. I will email you for page 2. Thank you, Janice Wood"

Additional Communication Between Claimant and Equitable Acceptance Corp And Doug Stewart Hide
  • Jan 06, 2012, Equitable Acceptance Corp and Doug Stewart (responding party) added:
  • To Whom it may concern. Janice Wood purchased a Rainbow Vacuum from a Rainbow salesperson. She signed a contract, provided her ss# and her drivers liscence for security. After repeatedly asking for a discount the salesperson decided to credit her purchase at Equitable Acceptance $400 . This discount was not normal and is not a normal occurance but it is what Janice Wood agreed to and now she is still unhappy. She has continuously e mailed us different stories and different complaints.

Equitable is the Finance company that accepted the contract for purchase not before verifying by telephone, and reviewing the signed contract and credit application. Doug Stewart is not part of this transaction other than the person that was able to get the salesperson to accept a 400 dollar discount and get the finance company to lower her principal balance by 400 dollars once the salesperson sent in the money.

Janice Wood purchased the Rainbow, verified, complained and got a 400 dollar credit applied and is still looking to intentionally inflict and interfere with our daily lives.

We considered this situation solved when she agreed that a $400 dollar discount and allowing her to keep her old Rainbow was agreed upon. She e mailed and confirmed for us to send in the $400 dollars to EA Corp. We did as she requested and are interested in anything other than what was agreed upon .
