Statement of Claim
Claimant says:
"I had to replace the engine in my 2010 Dodge truck. Endurance had already said they were going to pay for it until they found out that the work had already been started. It took them 9 days to decide to pay for it. The truck is the only vehicle i own. We needed transportation because of my wifes health. "

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "On 9/5/18, a representative from the consumer's repair facility contacted Endurance to file a claim for engine repair. Upon review of the CarFax, it was determined that there was a mileage discrepancy. The consumer activated the contract on 3/23/18 and provided a mileage of 111,234. Per the vehicle's CarFax, the vehicle had 115,405 miles on 1/12/2018. As the mileage provided by the consumer was falsified, the contract terms could not be properly assessed and the claim was declined. The consumer contacted his selling agent, who finally provided Endurance with documentation to correct the mileage issue on 9/12/18. Endurance reached out to the consumer's repair facility on 9/12/18 to continue the claims process, but no one from the repair facility was available. A representative from the repair facility contacted Endurance on 9/14/18 and advised Endurance that the work had already been performed.

    As the work had been performed without any prior authorization and without Endurance's ability to confirm failures, the claim was declined. The delay in the claim was due to the consumer's misreporting of his mileage.

    At this time, the consumer's contract is active and eligible for future claims. If the consumer wishes to discontinue coverage, he may contact his selling agent to do so."

    If the repair was covered, then of course Endurance should pay, regardless of who did the work. Contact your state Insurance Commissioner More...
