"I gave Benjamin Oriaifo $8000.00 to bid on a car for me, I've been to his shop on 2996 E Belmont and I seen for myself other cars that he bid on for other people. He never did bid on a car for me. He operates under EQUIPMENT BUILDER & POWER PROVIDER and EBPPINC. Automotive Repair 2996 E Belmont Av Fresno, Ca 559 307 5035. I found out that Benjamin has done this to others at the church we belong to, this matter has been reported to Fresno police dept."

  • In this situation, because you have already paid this person to bid on a car for you, and he did not, you are owed back what you paid him for his nonperformance. However, you sited recovery for pain and suffering, which is not an allowable damage under breach of contract. You are allowed your return of money, plus any actual foreseeable financial loss that resulted from the nonperformance of the contract.
