Statement of Claim
Claimant says:
"I got in a car accident the end of September, basically the car completely just malfunctioned. The tire went out and I spun around in a circle three times. I went off road and I hit two trees in the process. When I initially got the car four months ago I was told that i could pay insurance through Drive Time but also pay liability through State Farm and it would equal full coverage. So i called Drive Time and they told my insurance expired because of non payment. So as of right now i am furious because no one notified me of non payment and also because now i am being told that i have to pay for this accident. I told them that i have three accounts, one i used to pay my bills and my own personal account. So i wasn't aware that the insurance wasn't being paid for. So at this moment in time they're telling me they can't do anything for me. Not only did the car malfunction but the airbags never went off. So i could've been seriously hurt. The company not only does not care they basically just tell me the same thing over and over. I also have Gap insurance and they have yet to get back to me about anything. So now I'm taking things into my own hands."

  • 1) Have you reviewed your paperwork about the insurance option through Drive Time? I don't understand why you chose to have two different insurance policies instead of one - what was the supposed advantage? Were you required to set up an account and pay monthly premiums or did you pay one annual premium at the time of purchase?

    2) How old was the car? The manufacturer may have some liability if the airbag didn't operate properly. However, I believe airbags are supposed to be serviced after 10 years. If the car is older than that, did Drive Time warn you about it?
