Statement of Claim
Claimant says:
"While I was living at 661 Baniff Dr. Newman, Ca with my brother in Oct-2009 I had D-tv until I moved in February 2010. The apartment complex I moved to would not allow D-tv to install any satalites on the property. So the service was cancelled and I went with comcast for 2 years until i moved again to my current address and I have proof of that. the D-tv equipment was mailed back to them but now i'm receiving a bill for $485.64. I've tried calling d-tv to resolve this but got nowhere. I've been getting harassing phone calls and bills for the disputed amount. They have sent this to collections. I am trying one last thing before I seek legal counsel."

  • From reading your complaint, it sounds like this has been something that has 1) been reported to a collections agency, and 2) is showing up on your credit report.

    In regards to the collections agency action, if you have not done so already, you should write them a letter requesting a proof of the debt – i.e., a debt validation request. Here, this shows you are disputing the debt, and are requesting proof that you actually owe it. Unfortunately, usually if a matter has been referred to collections, most likely the original company (DirecTV) has sold the rights to collect the debt, and will probably not have much information for you beyond that it has been referred to collections.

    In regards to the credit report, you always have the right to write a rebuttal to anything showing up on your credit report that you feel is there in error. You can put that you are disputing owing the debt for a temporary measure.

    In summary, while DirecTV may be the source of the original complaint, who you will have to deal with at this point is the collections agency, and they have to show proof you owe a debt if you request that validation.
