Statement of Claim
Claimant says:
"They supposedly fixed the transmission after they allegedly tested trans. This was not why took car to them instead had other issues but I changed mind after finding out price for trans was as much as all other labor parts combined. Agreed then to let them fix but have to wait week or and half and so did but work was not worth $1500. This is for the 2000 Pontiac Bonneville that my mother has gave me to use so I left on bus Nov 2, 2015 to Selma, OR and got back with car to Topeka, KS Nov 14, 2015 with no mechanical issues. I have made or 4 trips to Leon and Towanda, KS in Butler County and 2 or 3 to Lawrence, KS before problems. Found the receipt for payment to them and it was paid May 20, 2016 and it has the email desiautorepair@yahoo.com.

Anyway they got the car back in early May when I took it for estimate and told them have trouble with drive but not 1,2,3 or Reverse. I wanted estimate and now if they could fix it and how long. They end up saying trans was shot and need replaced and caused me to miss understand they put in a poor used trans not new. The car lasted on week and half or two before band broke or according to few older people popped out as band can't break. The car was took to them mid or May and not get it back until 6/21/16 and on 6/22/16 something bad happened which caused all transmission fluid to leak out while head to work and left puddle where I was parked at State Farm Insurance parking in back since my work had parking lot being fixed. So I bought 2 bottles of trans fluid made it as far as where turn at my apt complex entrance split. I had to get another bottle as well as pushed by my brother on passenger side, me driver side, and maintenance guys vehicle pushing my bumper.

I would have to let the vehicle set there until I towed it to Certified Transmissions but going to cost over $2000 which not have and already paid $1500 to Desi and felt I give them last chance since had warranty or limited as such. However, that was back mid to late July and they have not called I called multiple times and was "we told get back to you", "your vehicle is next", "wait on part and as soon as comes we get it going", and "I go talk to mechanic since Abdull not here (owner) and call you back or have mechanic call you", which non of those happened until late August. I even go similar statements when personally went there by ride from neighbor whose van had problems. I was also told back at end of July that when they get the part the will charge me for it and labor since new item need replaced. I disagree with that concept then and still do since not my mistake and they had vehicle three times and ran worse after got back twice but second not last a day. Heck now remember Certified said they took lot of debris out of trans pan or something and that the trans was poor conditioned used one. That they have someone in NE who job is to rebuild trans and make sure they work then ships to them. I not have money nor credit for such nor credit or debit card that work so unable to get accepted.

So anyway car towed back to Desi Auto or Deals Auto repair as said earlier and car is still there and as far as I know they got part but not worked on my mother car for me nor called me. I just called again last 2 weeks with no answer last week and on 9/12/16 lady said she check with mechanic and give me a call back since I gave my number once again and that she remember me calling before. However, she kept saying 2008 Pontiac and different model. I had said with OR plates and last time I called after they plates expired since was good until July 16 but can't get inspected or what need since at their shop.

I'm angry, disappointed due to lack or service with time and professional repairs, and to seek claims action for refund of what was paid to them so can get car fixed else where and tags renewed or switched to KS but need inspect first. These guys fixed brakes and another issue with my old car I had from 2011 to 2014 and made lots of trips in but not going to them again and only went this time since manager and owner both have used Desi for years but now manager says he's not going back either. I could have started groundwork in legal career for which earned degree from Washburn University, general secretary, or records and file clerk, or front desk receptionist secretary at few business or offices in other states. I am stuck at apt and in Topeka still due to this issue and little to with credit being rebuilt still after 2010 Chpt 7 Bankruptcy and recent debts being clear from recent jobs obtained past 2 years. Okay this is all for now and will update or attach documents as I find them."

    This sound very complicated. Did you sign a document for them to work on transmission. Usually they will rebuild a transmission, not put in new. What about the original reason you took it to the mechanic. Was that fixed? More...
