Statement of Claim
Claimant says:
"One day I went through the Desert Express automated car wash in La Quinta, CA after I had just thoroughly rinsed my car with a hand held power washer at another self-service car wash to eliminate the loose soil on my car. After going through the car wash at Desert Express, I was in the process of drying my car completely when I noticed scratches on the left rear bumper of my car. I quickly filed a report with the attendant and she and I took pictures of the damage. After a few days of a run around by the manager, I finally spoke to her by phone and gave her my explanation of how I didn't see damage when I rinsed it prior to going through her wash. She informed me that she would investigate the claim and call me back which never occurred. After going back to the car wash for the third time, the manager informed the attendant by phone to relay to me to go over and speak to the owners of the car wash a short distance away. I finally spoke to the owner who at the time says he's just the manager of Desert Express. He strongly argued with me and denied that his car wash had anything to do with my car being damaged. He then had one of his detail workers buff my car to try to eliminate the damage. Although it did help remove some of the scuffs and scratches, it still apparent that the clear coat and a few scratches on my paint are not going to be removed unless it gets painted. The owner clearly refused to accept responsibility for the damage to my car so I called the local sheriffs department for assistance. When the sheriffs arrived they just informed me that I would have to spend $170.00 to file a small claims suit against the owner with the Riverside County Courts. Just to give you a history of my car and myself, I just recently had it painted so I know exactly the condition of my car at all times. I'm very particular about my car and just 15 minutes beforehand when I sprayed it off with the power washer there was no damage to be seen. I without a doubt would have noticed the damage to my car at that point if it occurred prior to going through Desert Express Car Wash."
