Statement of Claim
Claimant says:
"My name is Brown Sushiel, and I have Pickup truck which belongs to my wife, and I had a accident few weeks back and insurance company had send me check to fix my check...I went to dent shop called as Dentmaster,1310 W.Franklin Blvd Gastonia,NC 28052...He said he will repair and Painting work for $500,He took money in advance, and he did a horrible job. I have spend another 150 dollars, He also used my pickup truck for his personnel use and damage motor belt...and he is asking for more money and scaring me that he will put a lien on my pickup truck and tow it..so what should I do..."

  • Mr. Brown Sushiel I would contact the insurance company and explain all what is going on. See how they can help you. If Dentmaster has a coporate office then call and let them know to about your situation. Another thing you can do is call Better Business Bureau and report the business practices that are transpiring at Dentmaster. I hope you have all your documents to support your claim. He does have to notify you that there is a lien on the truck. If you do have to pay Dentmaster to prevent lien against the truck you can take your claim to small claims court and have the Judge resolve your dispute.

  • In this situation, you definitely want to keep your insurance company apprised of the situation. They gave you money for repairs, not for your truck to be taken from you. Do you have an invoice from this company that shows what repairs are to be done and an estimate of those repairs? Per North Carolina state law, it seems they may be required to have prepared a written repair estimate and provided it to you. If you have that and the proof of the money paid, that can definitely help you in your claim.

  • Hi Mr. Sushiel, I'm for sure if the insurance company sent you to this shop or not. But if so contact your insurance company to let them know the situation. If this is a shop you went on your own. Take pictures of the damages to the truck. Show proof that the repairman drove your truck. Gather all document showing that you paid a deposit upfront. Contact the corporate office to Dentmaster if this is a private own business Contact a lawyer explain your situation as the attorney to write a demand letter for the damages your claiming including the attorney fees. I might add if you do end up in smalls claims court you will be the one that have to prove your claims so keep real good records.
