Statement of Claim
Claimant says:
"In March I ordered a bridesmaid dress for a May wedding. When I ordered (which was a nightmare in and of itself, and David's Bridal has still not addressed the issue) I was very careful to opt out of any promotional mailings. Within 48 hours I began receiving emails from David’s saying “congratulations on your engagement!” It was news to me that I was engaged, but I quickly hit 'unsubscribe' and went on with my life. But much to my horror, I next began being bombarded almost hourly by individual contractors like Mary Kay reps, caterers, florists and invitation companies to 'help me prepare for my special day.' They soon started to call my personal cell phone and it felt as if I was spending half of my day dealing with calls and emails from these companies.

It turns out that it is actually in the David’s Bridal terms and conditions that they may 'share, sell, trade, or rent your personal information,'' regardless of whether or not you opt out of promotional mailings. You can’t unsubscribe because each individual provider has their own email list, making it virtually impossible to get out of this trap. I’m thick-skinned and I'm merely upset about the time lost dealing with this and the disclosure of my information to random companies, but I’d imagine that for girls who have been through break-ups or who aren’t engaged and want to be, this is absolutely tortuous.

The companies presumably paying to receive these leads from David's Bridal are also getting a bum deal, but that's their problem.

Because I do not live in California, it is apparently permissible for David's Bridal to throw me to the wolves without my consent. Here's the relevant part oftheir policy:

"Third Parties: David's Bridal may share your personal information with Men's Wearhouse (or Moores, The Suit People, Inc., d/b/a Moores Clothing for Men, for our Canadian customers) for direct marketing purposes. David's Bridal may also choose to share, sell, trade, or rent your personal information to other third parties for direct marketing purposes (i.e., offering goods and services that we believe would be attractive to our customers). We require all third parties with whom we share information (including personal information) that we collect to handle that information in accordance with this privacy policy. However, these third parties may also have additional or different privacy practices that you may find on their respective Web sites. You may also go to their Web sites to find out more about technology they use to collect information while providing us with services."

So these companies have to abide by David's privacy policy -- which is to "share, sell, trade, or rent your personal information to other third parties for direct marketing purposes."

I am appalled and will do everything in my power to protest this company's unabashed use of me as a profit center.

  • I think I'd refuse to be part of a bridal party if I was required to get a dress from a company like this. that's a really shocking policy. So not only can they sell your info to all and sundry, but all and sundry can also sell your name in turn?

    I don't see any fair resolution to this at all except for David's to be totally transparent about their policy--or better, to have an 'opt in.' Some people like these services--great, if they want them, they'll opt in. David's is also selling the info on false pretences IMO.
