Statement of Claim
Claimant says:
"I brought my sewing machine in for repair on Dec. 11, 2012. I received it back on Dec. 17, 2012 and used my credit/debit card to pay in full, $94.32. I found that the same problems continued with my machine, reported it via phone to Henry, the owner? The following business day, Dec. 22, 2012, I returned the machine to the store for them to repair it again. The owner told me it would be ready for pick up by the end of the week. I called continuously as I did not receive any information regarding pick up after that time. It appeared as if the machine was not looked at until this Friday, Dec. 28, 2012. Henry reported that the machine had a broken part, (which it did not have when I inserted it into the case upon return to the store). I told him I would not be responsible for the part cost and that it did not have any bearing on the way the machine operated at the time I returned it the second time for repair.
I called the store on January 3 to see if I could pick up my machine as I assumed it was repaired. The owner accused me of breaking the spool, not admitting it and returning the machine for repairs so they could absorb the cost of the part. This is not true.
I refused to ok the additional charges at which time I asked for a refund and told the owner that I would pick up the machine. He said "There are no refunds" and hung up on me. He did not pick up my calls thereafter, 5 calls. I went to the store, requesting my machine today. He ignored me, then told me he would not repair the machine as I told him not to, would not return it to me as he wanted to wait the 30 days until my credit cleared. I paid with a debit/credit card which the credit charge has already cleared. I will have to call the police to escort me to attempt to get my machine. I am not hopeful that I will get a monetary refund."

  • As the credit charges have cleared and the owner of the shop has been officially paid, there is no reason for the owner to continue to hold your machine without your consent or permission. As visiting the shop has not gotten you any resolution, perhaps a certified letter indicating that as the repair price has been paid and cleared your credit account, you consider your business dealings to be done and will be picking up your machine. While calling the police may be drastic option, he is technically withholding from you your belongings.
