Statement of Claim
Claimant says:
"i originally hired Jammie through Mitcham Contracting Inc. to do metal work on a walkway and i guess he hired his own company (Dalton Tree and Home Care) as a contractor to do the work which was finished in 2-3 days approx. i had no issue with that and the 3rd party contractor he hired did the metal work and cleaned up. i have a signed contract from both companies.

while working at my house he stated that he could paint and re-grout my back patio deck for $1000. he started the work and found an issue with the tile as it wasn't "glued" to the base. when he removed the grout the tiles pulled off. not all of them just the ones toward the edge. he suggested we rip out all the tile and relay new tile the proper way. i agreed $2600 for labor to demo, re-tile and paint the back patio deck. i just needed to pay for material. the only receipt i have is for the tile and the signed contract which listed what needed to be done.

this started sometime in March or April 2014 for the tile work and now it is January 2015. the tile was placed and painted in 2 days approx. after the work was done for the first time questions came up about the tiles not being straight or even. was told give it 24hrs to settle and it would fall into place. well it didn't and this is where my long journey starts. Jammie came out 15+ times to try and fix the tile, it even got to a point where i said all this cutting and re-aligning of the tiles isn't working and i need it all ripped out again and done properly. after a few back and forth conversations Jammie agreed but i was told i needed to pay for self leveling cement and that was the cause of my issue. i agreed to pay for it but when they came to do the work they bought regular cement. to me that is not my issue if i recall i paid like $110 for that. they relaid the tiles and grouted, gave it a few days to settle. after which some of the tiles moved and in some spots its not even or aligned properly and also when it rains water builds up in certain spots. i called Jammie again he agreed he sees the issue and said he would fix it before it got too cold again. well guess what he didn't show up 2 times and the 3rd time he came to the house for 2-3hrs cut the grout out of a few tiles and left it. this is where i said enough is enough and i wanted my money back. im glad i took pictures each time he did work because it shows a clears story of what he tried to do each time. so now not only is my patio ugly and grout missing but the paint job he did correctly is stained with floor cement and grout from the multiple times he cut and put back tiles.

we spoke one more time because he had to pick up his "ladder" which he had left at my house for 6 months, this is when he told to get another estimate from one of his buddies and he would pay for it, if the price sounds right, he agreed that if his buddy didn't call me he would put a claim in with his insurance company to make sure i was taken care of. well his buddy never called me so i asked him for my money back and i get the sob story about how i am trying to take advantage of him when its the other way round. i am in the process of filing claims against him since he refuses to accept responsibility for the horrible work his company did. well pictures don't lie, and i have the txt msgs and a contract that is signed by both of us."
